File Number: 17-124 <br />WHEREAS, these provisions are subject to periodic modification in response to new <br />State laws and changes to the California Government Code; and <br />WHEREAS, Section 65852.2 of the California Government Code was amended in <br />September 2016 as a result of the passage of Senate Bill 1069 and Assembly Bill 2299; and <br />WHEREAS, cities and counties across the State of California must revise their <br />Accessory Dwelling Unit regulations by January 1, 2017 to implement the new requirements, <br />and submit their revised regulations to the California Department of Housing and Community <br />Development within 60 days after they become effective; and <br />WHEREAS, the amendments to Article 5, Section 2-576 would meet all requirements <br />of the revised Government Code and are consistent with the new State guidelines for <br />Accessory Dwelling Unit regulations published by the California Department of Housing and <br />Community Development in December 2016; and <br />WHEREAS, amendments to the other sections of the San Leandro Zoning Code are <br />contained within this Amendment to ensure internal consistency throughout the Code; and <br />WHEREAS, the Planning Commission of the City of San Leandro considered these <br />amendments at its public hearing held on Thursday, February 16, 2017, found them to be <br />consistent with the General Plan, and recommended City Council adoption by a 5-0 decision; <br />and <br />WHEREAS, the revisions to the Zoning Code are incorporated herein by reference, <br />and are available for review at City Hall during normal business hours. <br />NOW THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />SECTION 1. Recitals. The above recitals are true and correct and made a part of this <br />ordinance. <br /> <br />SECTION 2. CEQA. The amendments to the Zoning Code are statutorily exempt from <br />the California Environmental Quality Act under Public Resources Code Section 21080.17. <br /> <br />SECTION 3. Findings. Based on the entirety of the record, the City Council hereby <br />finds that the Zoning Code amendments, as shown in the attached Exhibit A and B and <br />incorporated herein by reference, are consistent with the 2035 General Plan adopted in <br />September, 2016. The City Council further finds that consideration of the proposed <br />amendments complies with the notice and hearing provisions of the Zoning Code. <br />SECTION 4. Amendment of Zoning Code. Article 3, Definitions, Article 5, Residential <br />Districts, Article 16, Development Regulations, Article 17, Off-Street Parking and Loading <br />Regulations, Article 25, Site Plan Approval, and Article 30, Inclusionary Housing of the San <br />Leandro Zoning Code are hereby amended, as shown in the attached Exhibits A and B, <br />incorporated herein by reference. <br />Page 2 City of San Leandro Printed on 3/28/2017 <br />148
