WHEREAS,the amendments to Article 5, Section 2-576 would meet all requirements of the
<br /> revised Government Code and are consistent with the new State guidelines for Accessory Dwelling
<br /> Unit regulations published by the California Department of Housing and Community Development
<br /> in December 2016; and
<br /> WHEREAS,amendments to the other sections of the San Leandro Zoning Code are
<br /> contained within this Amendment to ensure internal consistency throughout the Code; and
<br /> WHEREAS,the Planning Commission of the City of San Leandro considered these
<br /> amendments at its public hearing held on Thursday, February 16, 2017, found them to be consistent
<br /> with the General Plan, and recommended City Council adoption by a 5-0 decision; and
<br /> WHEREAS,the revisions to the Zoning Code are incorporated herein by reference, and are
<br /> available for review at City Hall during normal business hours.
<br /> NOW THEREFORE,the City Council of the City of San Leandro does ORDAIN as follows:
<br /> SECTION 1. Recitals. The above recitals are true and correct and made a part of this
<br /> ordinance.
<br /> SECTION 2. CEQA. The amendments to the Zoning Code are statutorily exempt from the
<br /> California Environmental Quality Act under Public Resources Code Section 21080.17.
<br /> SECTION 3. Findings. Based on the entirety of the record,the City Council hereby finds
<br /> that the Zoning Code amendments, as shown in the attached Exhibit A and B and incorporated herein
<br /> by reference, are consistent with the 2035 General Plan adopted in September, 2016. The City
<br /> Council further finds that consideration of the proposed amendments complies with the notice and
<br /> hearing provisions of the Zoning Code.
<br /> SECTION 4. Amendment of Zoning Code. Article 3,Definitions,Article 5,Residential
<br /> Districts,Article 16,Development Regulations,Article 17,Off-Street Parking and Loading
<br /> Regulations,Article 25, Site Plan Approval,and Article 30,Inclusionary Housing of the San Leandro
<br /> Zoning Code are hereby amended,as shown in the attached Exhibits A and B, incorporated herein by
<br /> reference.
<br /> SECTION 5. Severability. If any section, subsection, subdivision,paragraph, sentence,
<br /> clause or phrase of this Ordinance, or its application to any person or circumstance, is for any reason
<br /> held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or
<br /> enforceability of the remaining sections, subsections, subdivisions,paragraphs, sentences, clauses or
<br /> phrases of this Ordinance,or its application to any other person or circumstance. The City Council of
<br /> the City of San Leandro hereby declares that it would have adopted each section, subsection,
<br /> subdivision,paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or
<br /> more other sections, subsections, subdivisions,paragraphs, sentences, clauses or phrases hereof is
<br /> declared invalid or unenforceable.
