IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2017-070 <br />RESOLUTION MAKING A SOLE SOURCE FINDING UNDER CALIFORNIA PUBLIC <br />CONTRACT CODE SECTION 3400(C)(3) APPROVING A PURCHASE BY THE <br />WATER POLLUTION CONTROL PLANT (WPCP) OF ONE THOUSAND AERATION <br />BASIN FINE -BUBBLE MEMBRANE DIFFUSERS FROM EVOQUA WATER <br />TECHNOLOGIES FOR AN AMOUNT NOT TO EXCEED $86,000 <br />WHEREAS, the WPCP needs to replace all aeration system diffusers to maintain <br />operational efficiency; and <br />WHEREAS, Evoqua Water Technologies is the only U.S. vendor that can supply the <br />WPCP said diffusers; and <br />WHEREAS, funding for said purchase is available in fiscal year 2016-17 WPCP <br />appropriation; and <br />WHEREAS, the City Manager recommends approval of said sole source purchase. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the City Council makes a finding under California Public Contract Code <br />section 3400(c)(3) that it must make a sole source purchase because the product is only available <br />from one source. <br />2. That the Sole Source purchase by the Water Pollution Control Plant of said <br />diffusers is authorized, for an amount not to exceed $86,000, and the City Manager or his designee <br />is authorized to execute all documents and take all actions to effect this purchase. <br />Introduced by Councilmember Cox, and passed and adopted this 15th day of May, 2017, <br />by the following vote: <br />Members of the Council: <br />AYES: Councilmembers Ballew, Cox, Hernandez, Lee, Lopez, Thomas; <br />Mayor Cutter (7) <br />NOES: None (0) <br />ABSENT: None (0) <br />ATTEST: <br />Tamika reenwood, City Clerk <br />
