File Number: 17-283 <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br /> <br />1. That the City of San Leandro declares it is eligible to request an allocation of <br />TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code; and <br /> <br />2. That there is no pending or threatened litigation that might adversely affect the <br />project or projects described in Attachment B to this resolution, or that might impair the ability <br />of the City of San Leandro to carry out the project; and <br /> <br />3. That the project has been reviewed by the Bicycle and Pedestrian Advisory <br />Committee (BPAC) of the City of San Leandro; and <br /> <br />4. That the City of San Leandro attests to the accuracy of and approves the <br />statements in Attachment A to this resolution; and <br /> <br />5. That a certified copy of this resolution and its attachments, and any <br />accompanying supporting materials shall be forwarded to the countywide transportation <br />planning agency and Alameda County for submission to MTC as part of the countywide <br />coordinated TDA Article 3 claim; and <br /> <br />6. That $82,700 of TDA Article 3 grant funds must be appropriated for the <br />Annual Street Sealing Project 2018.0070 (Fund 150-36-009) in the City’s Fiscal Year 2017-18 <br />Budget in order to fully fund the project. <br />Page 2 City of San Leandro Printed on 5/30/2017 <br />119
