Presuming that the above conditions are met, and subject to the specific terms and conditions stated <br />in the Agreement, the Developer shall: <br />Purchase the Site all cash from the Agency for $207,000. <br />2. Pay all title insurance premiums, and one-half of the conveyance and transfer taxes, <br />recording fees and escrow fees. <br />3. Complete the construction of the improvements by June 1, 1998. The Developer <br />must ensure that the improvements to the subject Site are constructed, used and <br />maintained in accordance with the provision of the Plaza 2 Redevelopment Plan and <br />within the time frame specified within the DDA. <br />4. The Developer will implement all reasonable mitigation and monitoring measures <br />during the construction period, as required by the Agency or the City of San Leandro <br />pursuant to CEQA. <br />5. Secure a tenant to open the improvements and continue to operate for no less than <br />twenty (20) years. <br />6. Use its best efforts, along with the Agency, to establish a common parking lot and <br />mutual egress and ingress through reciprocal easement and cross parking agreements <br />with adjacent property owners. <br />7.
