IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2017-119 <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT <br />NO. 1 TO NON-PROFESSIONAL SERVICES AGREEMENT WITH PACHECO <br />BROTHERS GARDENING, INC. FOR CITYWIDE MEDIAN MAINTENANCE FOR <br />$189,712 FOR FISCAL YEAR 2017-2018, AND TO EXECUTE THREE ADDITIONAL <br />ONE-YEAR EXTENSIONS AT THE SAME PRICE SUBJECT TO CONSUMER PRICE <br />INDEX (CPI) ADJUSTMENTS IN FUTURE YEARS <br />WHEREAS, a draft amendment to the agreement between the City of San Leandro and <br />Pacheco Brothers Gardening, Inc. was presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, the City Manager recommends approval of said amendment to the <br />agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That said Amendment No. 1 to the agreement substantially in the form presented is <br />hereby approved and execution by the City Manager is hereby authorized; and <br />2. That the City Manager is authorized to make non -substantial revisions to said <br />agreement, subject to the approval of the City Attorney; and <br />3. That the City Manager is authorized to execute Amendment No. 1 for a total contract <br />price of $189,712 for fiscal year 2017-2018, and to execute three additional one-year extensions at <br />the same price subject to Consumer Price Index (CPI) adjustments in future years; and <br />4. That an original executed Amendment No. I to the agreement shall be attached to and <br />made a part of this resolution. <br />%/I <br />
