IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2017-147 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A STANDARD <br /> PUBLIC IMPROVEMENT AGREEMENT WITH SAN LEANDRO SENIOR <br /> ASSOCIATES, LP, FOR PUBLIC IMPROVEMENTS ON CARPENTIER STREET <br /> WHEREAS,the City approved Site Plan Review PLN2008-00030 at 1400 San Leandro <br /> Boulevard with Bridge Housing Corporation(as applicant) and Bay Area Rapid Transit District(as <br /> property owner)that permits the development of a two phase affordable housing project; and <br /> WHEREAS,the Conditions of Approval for said Site Plan Review require the applicant to <br /> construct certain public improvements, and <br /> WHEREAS, a Standard Public Improvement Agreement between the City of San Leandro <br /> and San Leandro Senior Associates, LP, a copy of which is attached, was presented to this City <br /> Council to assure construction of public improvements; and <br /> WHEREAS, said agreement conforms to San Leandro Municipal Code Section 7-1-945 et <br /> seq., and <br /> WHEREAS, said agreement is guaranteed by a Faithful Performance Bond and a Labor <br /> and Materials Bond issued by International Fidelity Insurance Company, each in the amount of <br /> $133,391.50; and <br /> WHEREAS, the City Council is familiar with the contents thereof; and <br /> WHEREAS, the City Manager recommends approval of said agreement and acceptance of <br /> said bonds. <br /> NOW,THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That the Standard Public Improvement Agreement between the City of San Leandro <br /> and San Leandro Senior Associates, LP, substantially in the form presented is hereby approved <br /> and execution by the City Manager is hereby authorized; and <br />
