City Council Handbook | 2017 <br /> <br /> <br />39 San Leandro City Council <br /> <br />BOARD OF APPEALS <br /> <br />Description of Board Duties: <br />The Board of Appeals created under Section 7-5-110 of the San Leandro Municipal Code shall <br />hear and decide appeals of orders, decisions, or determinations made by the Building Official or <br />Fire Marshall relative to application and interpretation of this Article. <br /> <br />The Board shall adopt reasonable rules and regulations for conducting its hearings and shall <br />render all of its decisions and findings in writing. The decision of the Board shall be final and <br />conclusive on matters relating to the suitability of alternative materials and types of construction. <br />Upon receipt of the Board’s written decision, the Building Official/Fire Marshall shall proceed in <br />accordance therewith. <br /> <br />MEMBERSHIP: <br /> <br />The Board shall consist of five (5) members to be appointed by the Mayor, four (4) of whom shall <br />be registered civil engineers, all who are qualified by experience and training to pass upon <br />matters pertaining to building construction, engineering, or fire inspection. In addition thereto, <br />the Building Official shall be an ex officio member, shall act as Secretary to the Board, and shall <br />have a voice but no vote. The members appointed by the Mayor shall hold office at the Mayor’s <br />pleasure. <br /> <br />MEETING SCHEDULE: <br />The Board of Appeals meets on an as-needed basis. <br /> <br /> <br />77
