IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2017-180 <br /> RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A LEASE <br /> AGREEMENT WITH EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD) <br /> FOR CHABOT PARK (PROVIDES FOR THE GENERAL MAINTENANCE OF CABOT <br /> PARK,TREE MAINTENANCE, AND IMPLEMENTATION OF A TREE HAZARD <br /> EVALUATION PLAN) AND FOR CITY COUNCIL APPROPRIATION APPROVAL <br /> OF 5154,000 TO FUND THE LEASE AGREEMENT REQUIREMENTS <br /> USING THE 2017-18 GENERAL FUND ECONOMIC UNCERTAINTY RESERVES <br /> WHEREAS, an agreement between the City of San Leandro and East Bay Municipal Utility <br /> District(EBMUD), a copy of which is attached,was presented to this City Council; and <br /> WHEREAS, the City Council is familiar with the terms of the agreement; and <br /> WHEREAS,the City Manager recommends approval of'said agreement. <br /> NOW,THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That said agreement in an amount not to exceed$4,000 per year, plus 3.5%annual <br /> adjustment is hereby approved; and <br /> 2. That the terms of the agreement will be memorialized in writing by the City Manager, <br /> subject to the approval of the City Attorney* and <br /> 3. That the City Manager is authorized to execute said agreement- and <br /> agreement; <br /> 4. That an original executed agreement shall be provided to the City Clerk, and be <br /> attached to and made a part of this resolution. <br /> 5. That the City Council approves an appropriation of$154.000 to fund the lease <br /> agreement requirements using the 2017-18 General Fund Economic Uncertainty Reserves ($150,000 in <br /> z- <br /> 0 10-33-001 and $4,000 in 010-61-019-5630). <br /> Introduced by Counc i I member Cox., and passed and adopted this 18th day of"December 2017, <br /> by the following vote: <br /> Members of the Council: <br /> AYES: COLInCilmembers Cox, Hernandez, Lee, Lopez, Thomas; Mayor Cutter (6) <br /> NOES: Councilmember Ballew (1) <br /> EXCUSED: None (0) <br /> A'ITEST: <br /> Tamika Greenwood, City Clerk <br />
