,k s CAPITAL IMPROVEMENT LOAN AGREEMENT THE CITY OF SAN LEANDRO AND HOUSING CONSORTIUM OF THE EAST BAY This Loan Agreement for Capital Improvements (this "Agreement") is entered into by the City of San Leandro ("City"), a California charter city, and Housing Consortium of the East Bay ("Participant") and is dated this day of October 1, 2017("Effective Date"). City and Participant are hereinafter collectively referred to as the"Parties." RECITALS A. City is the recipient of Community Development Block Grant("CDBG")funds. B. Participant owns and operates that certain real property located at 342 West Joaquin Avenue, San Leandro, California, legally described in Exhibit A (the "Property"). The Property is also known as Luella Fuller Group Home and serves as affordable rental housing for persons with developmental disabilities, C. Participant desires to perform the capital improvements as described under the Scope of Work in Exhibit D or related to the Property, including Americans with Disabilities Act(ADA) improvements, and seeks City's assistance to accomplish this goal(the"Improvements"). D. City desires to provide CDBG loans to qualified local nonprofit organizations like Participant in order to assist such organizations with capital improvement projects. E. City approved an amendment to its FY2010-2011 U.S. Department of Housing and Urban Development Annual Action Plan on October 1, 2017 to transfer $10,000 of unspent FY2010-2011 CDBG funds to Participant for rehabilitation of the Property. The Federal award date of the CDBG funds provided subject to this Agreement is: July 13, 2010. The Federal Award Number ("FAIN") for the CDBG funds provided subject to this Agreement is MC-06-0017 . The Catalog of Federal Domestic Assistance ("CFDA") for the CDBG funds provided subject to this Agreement is 14.218, F. City has determined that Participant is a qualified local nonprofit organization, is eligible to receive a loan of CDBG funds to construct the Improvements (the "Project Loan") and has Data Universal Number System Number: 111328402 G. Concurrently herewith, Participant shall execute a promissory note(the"Note")evidencing the Loan. This Agreement and the Note are collectively referred to as the"Loan Documents." NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged,the Parties hereby agree as follows: Capital Improvement Loan Agreement-HCE13 October 1,2017
