,k s <br /> CAPITAL IMPROVEMENT LOAN AGREEMENT <br /> THE CITY OF SAN LEANDRO AND <br /> HOUSING CONSORTIUM OF THE EAST BAY <br /> This Loan Agreement for Capital Improvements (this "Agreement") is entered into by the City of <br /> San Leandro ("City"), a California charter city, and Housing Consortium of the East Bay ("Participant") and is <br /> dated this day of October 1, 2017("Effective Date"). City and Participant are hereinafter collectively referred to <br /> as the"Parties." <br /> RECITALS <br /> A. City is the recipient of Community Development Block Grant("CDBG")funds. <br /> B. Participant owns and operates that certain real property located at 342 West Joaquin Avenue, <br /> San Leandro, California, legally described in Exhibit A (the "Property"). The Property is also known as Luella <br /> Fuller Group Home and serves as affordable rental housing for persons with developmental disabilities, <br /> C. Participant desires to perform the capital improvements as described under the Scope of <br /> Work in Exhibit D or related to the Property, including Americans with Disabilities Act(ADA) improvements, and <br /> seeks City's assistance to accomplish this goal(the"Improvements"). <br /> D. City desires to provide CDBG loans to qualified local nonprofit organizations like Participant in <br /> order to assist such organizations with capital improvement projects. <br /> E. City approved an amendment to its FY2010-2011 U.S. Department of Housing and Urban <br /> Development Annual Action Plan on October 1, 2017 to transfer $10,000 of unspent FY2010-2011 CDBG <br /> funds to Participant for rehabilitation of the Property. The Federal award date of the CDBG funds provided <br /> subject to this Agreement is: July 13, 2010. The Federal Award Number ("FAIN") for the CDBG funds <br /> provided subject to this Agreement is MC-06-0017 . The Catalog of Federal Domestic Assistance ("CFDA") <br /> for the CDBG funds provided subject to this Agreement is 14.218, <br /> F. City has determined that Participant is a qualified local nonprofit organization, is eligible to <br /> receive a loan of CDBG funds to construct the Improvements (the "Project Loan") and has Data Universal <br /> Number System Number: 111328402 <br /> G. Concurrently herewith, Participant shall execute a promissory note(the"Note")evidencing the <br /> Loan. This Agreement and the Note are collectively referred to as the"Loan Documents." <br /> NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is <br /> hereby acknowledged,the Parties hereby agree as follows: <br /> Capital Improvement Loan Agreement-HCE13 <br /> October 1,2017 <br />
