IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2018-043 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A NON- <br /> PROFESSIONAL SERVICES AGREEMENT WITH NEWTON CONSTRUCTION & <br /> MANAGEMENT,INC. FOR MARINA COMMUNITY CENTER RENOVATIONS IN <br /> THE AMOUNT OF $188,870.52 AND AUTHORIZING THE CITY MANAGER TO <br /> NEGOTIATE AND APPROVE CUMULATIVE CHANGE ORDERS UP TO 25% <br /> ($47,217.63) OF THE ORIGINAL CONTRACT AMOUNT <br /> WHEREAS, a draft agreement between the City of San Leandro and Newton Construction <br /> &Management, Inc. was presented to this City Council; and <br /> WHEREAS,the City Council is familiar with the contents thereof; and <br /> WHEREAS, Change Orders to modify bid quantities or to respond to unexpected <br /> conditions are a normal aspect of public contracting and construction; and <br /> WHEREAS, in order to deliver quality of public projects on schedule and within budget, <br /> the Council finds that authorizing approval of Changes Orders in the best interest of public health, <br /> safety, and welfare; and <br /> WHEREAS,the City Manager recommends approval of said agreement. <br /> NOW,THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That said agreement substantially in the form presented is hereby approved and <br /> execution by the City Manager is hereby authorized. <br /> 2. That the City Manager is authorized to make non-substantial revisions to said <br /> agreement, subject to the approval of the City Attorney. <br /> 3. That the City Manager or his designee is authorized to negotiate and approve <br /> cumulative change orders up to a maximum of$47,217.63, which is 25% of the original contract <br /> amount (account 4 687-18-007-5242). <br />
