Application Process <br />Prepare and submit a 401 Certification Application form, including the following information: <br />•Project description and site plan (including low impact development features) <br />•CEQA document and Notice of Determination <br />•Quantification of fill to be removed <br />•Quantification of temporary and permanent fill impacts <br />•Proposed mitigation (if needed, the project may mitigate itself) <br />•Payment of fees (based on quantity of fill) <br />Schedule <br />In accordance with guidance issued by the State Water Resources Control Board, the RWQCB is <br />required to make a determination of whether the application package is complete within 30 days of <br />receipt. However, sometimes the San Francisco RWQCB takes longer to respond and make a <br />determination. Once the application is determined complete, a permit is required to be issued within <br />60 days. <br />4.3 California Department of Fish & Wildlife <br />Background <br />Section 2081 subdivision (b) of the California Fish and Game Code allows the California <br />Department of Fish and Wildlife (CDFW) to issue Incidental Take Permits for any species listed <br />under the California Endangered Species Act (CESA) as endangered, threatened, or candidate as <br />long as the authorized take is incidental to an otherwise lawful activity. If the project impacts any <br />species that are listed under the CESA as endangered, threatened, or candidate, an Incidental <br />Take Permit would be required. <br />Applicability <br />The project could potentially impact species that are listed under the CESA as endangered, <br />threatened, or candidate. The species that could potentially be impacted include the state <br />endangered Delta smelt (Hypomesus transpacificus), the state threatened Central Valley spring-run <br />Chinook salmon (Oncorhynchus tshawytscha), and the state threatened longfin smelt (Spirinchus <br />thaleichthys). The open water habitat of the bay could be affected by construction and could result <br />in inadvertent injury or loss of individual fish species if present within the construction zone. <br />30
