Application Process <br />Prepare and submit a Major Permit application form, including the following information: <br />•Project description and site plan (including low impact development features) <br />•CEQA document and Notice of Determination <br />•Quantification of fill (solid, floating, cantilevered, piles-supported) to be removed within bay <br />•Quantification of fill (solid, floating, cantilevered, piles-supported) to be constructed within bay <br />•Breakdown of all improvements within 100-foot shoreline band <br />•Analysis of topography and predicted sea level rise, depicted on a project profile <br />•Proposed mitigation (Project may mitigate itself) <br />•Payment of fees (based on cost of project) <br />Schedule <br />Once submitted, the Commission has 30 days to determine whether the application is complete. <br />Specific to Major Permits, and once the application is determined complete, staff distributes a <br />summary of the application to the Commission and the public. No sooner than 28 days after the <br />application has been filed and at least 10 days after the application summary has been distributed, <br />the Commission holds a public hearing on the application. If the application is not complete, the <br />commission staff will respond in writing within 30 days notifying the applicant of the information <br />needs. The Commission has a maximum of 90 days to act on an application once it is determined <br />to be complete. <br />Some projects also are required to go through Design Review Board and Engineering Criteria <br />Review Board. The Shoreline Development project has been before the Design Review Board <br />twice, and is expected to be presented a third time. This process is being led by Cal-Coast <br />Development. The Shoreline Development does not include the type of buildings or structures that <br />would normally be required to go before the Engineering Criteria Review Board; therefore, this <br />review is not anticipated to be necessary. <br />4.5 Mitigation Plan <br />RWQCB, CDFW, and BCDC will require a mitigation plan for the net fill impacts that result from the <br />implementation of the Project. In developing a mitigation plan it will be important to document the fill <br />being removed, so that a net impact can be determined. This includes floating fill and cantilevered <br />fill. If the fill being removed is greater than the fill being added, it may be that the Project can <br />mitigate itself, and that no off-site mitigation would be required. This scenario applies only to fill, <br />and may not qualify for impacts to special-status species. <br />A preliminary inventory of the fill to be removed is shown in Table 4.1. Although the fill types are not <br />equal, in general the fill being removed would be significantly greater than the fill being placed. In <br />addition, the removed and placed fill would occur in the same spot, with the removed fill providing a <br />greater beneficial impact to the water and shoreline than the impact of the placement of fill. <br />Removal would have benefits from less shade, more open water, and better water quality. <br />32
