<br />17 <br />Additional Provisions Relating to Insurance. All insurance required to be maintained under the Lease may be maintained as part of or in conjunction with any other insurance <br />coverage carried by the City, and may be maintained in whole or in part in the form of the <br />participation by the City in a joint powers agency or other program providing pooled insurance. However, casualty insurance and rental interruption insurance may not be maintained by the <br />City in the form of self-insurance. Application of Proceeds of Hazard and Other Insurance <br />Pursuant to the Indenture, any Net Proceeds of insurance against accident to or destruction of the Leased Property collected by the City or the Authority in the event of any such accident or destruction shall be paid to the Trustee and deposited by the Trustee promptly upon <br />receipt thereof in the Insurance and Condemnation Fund. <br />If the City fails to determine and notify the Trustee in writing of its determination, within <br />45 days following the date of such deposit, to replace, repair, restore, modify or improve the Leased Property which has been damaged or destroyed, then such Net Proceeds shall be <br />promptly transferred by the Trustee to the Redemption Fund and applied to the redemption of <br />Bonds. The Indenture further provides that, notwithstanding the foregoing sentence, however, if the Leased Property is damaged or destroyed in full, the Net Proceeds of such insurance shall <br />be used by the City to rebuild or replace the Leased Property if such proceeds are not sufficient to redeem Outstanding Bonds equal in aggregate principal amount to the unpaid Lease Payments allocable to the Leased Property. <br /> All proceeds deposited in the Insurance and Condemnation Fund and not so transferred to the Redemption Fund shall be applied to the prompt replacement, repair, restoration, <br />modification or improvement of the damaged or destroyed portions of the Leased Property by the City, upon receipt of a Written Request of the City the contents of which satisfies the requirements of the Indenture. Any balance of the proceeds remaining after such work has <br />been completed as certified by the City under a Written Certificate to the Trustee shall be paid to the City. <br /> <br />No assurance can be given that the proceeds of any insurance will be sufficient under all circumstances to repair or replace the Leased Property or to prepay all of the Lease Payments <br />with respect to the Leased Property. Also, the City makes not representation as to the <br />sufficiency of any insurance awards or the adequacy of any self–insurance to pay, when and as due, amounts payable under the Lease or the Bonds. See “APPENDIX B – SUMMARY OF <br />PRINCIPAL LEGAL DOCUMENTS,” and “RISK FACTORS – Abatement.” <br />Condemnation <br />If the Leased Property is taken permanently under the power of eminent domain or sold <br />to a government threatening to exercise the power of eminent domain, the Term of the Lease thereupon ceases as of the day possession is taken. If less than all of the Leased Property is taken permanently, or if the Leased Property is taken temporarily, under the power of eminent <br />domain, then: (a) the Lease shall continue in full force and effect with respect thereto and does not <br />terminate by virtue of such taking, and the parties waive the benefit of any law to the contrary; and <br />
