File Number: 18-531 <br />recommends that the City Council adopt a resolution to amend the hours of use at the Shoreline <br />to unify enforcement regulations. <br />The current Administrative Code section with the language noted in the last bullet above has <br />changed. The current section is 7.1.305(d), with the full text as follows: <br />“The San Leandro Shoreline Recreation Area shall be open to the public daily from <br />one-half hour before sunrise to 10:00 p.m. and the park shall be closed to all persons and <br />no person shall be permitted to remain at the park (except as permitted in paragraph (e) <br />below) between 10:00 p.m. in the evening and one-half hour before sunrise in the morning <br />of the following day.” <br />Subsection (e) provides that the restriction noted in subsection (d) does not apply to Marina <br />berths, patrons of restaurants, customers of the golf course, members of the yacht clubs, etc. <br />Staff recommends the following amendments to section 7.1.305(d): <br />“The San Leandro Shoreline Recreation Area shall be open to the public daily from <br />one-half hour before sunrise 5:00 a.m. to 10:00 p.m. and the park shall be closed to all <br />persons and no person shall be permitted to remain at the park (except as permitted in <br />paragraph (e) below) between 10:00 p.m. in the evening and one-half hour before sunrise <br />5:00 a.m. in the morning of the following day.” <br />Although the proposed revision does not constitute a significant change to the regulations, it will <br />make enforcement more effective. Providing specificity in the hours will make it easier for staff to <br />enforce use regulations that do not depend upon interpretation of or reference to the time of <br />sunrise. Over the years staff has observed that there are many who utilize the Shoreline <br />Recreation Area early in the day, especially for exercise and fishing. Staff believes that stipulating <br />5:00 a.m. will adequately accommodate the early morning users. <br />Police recommend that signs be installed as follows: <br />·No Overnight Parking of RVs (SLMC 3-10-925 (c)) [existing signage] <br />·San Leandro Shoreline Recreation Area, Daily Park Hours 5:00 AM to 10:00 PM (SLAC <br />7.1.305(d)) [new signs to be installed] <br />Fiscal Impacts <br />If the resolution is approved, new signage will be made and installed. The cost for manufacturing <br />the new signs can be accommodated within the existing Shoreline budget.
