The Redevelopment Agency of the City of San Leandro ("Agency") and Trustor have <br />entered into a Property Value Restrictions, Resale Agreement and Option to Purchase dated <br />August 24, 2009, and attached hereto as Exhibit A (as amended from time to time, the "Resale <br />Restrictions"), pursuant to which Beneficiary promised, among other things, to only sell to a <br />qualified moderate -income purchaser ("Eligible Household") at a price not to exceed the adjusted <br />resale price capped at an affordable housing cost, <br />B. The City is the successor -in -interest to the Agency with respect to the Resale <br />Agreement. <br />NOW, THEREFORE, to secure the full and timely performance by Trustor of the Secured <br />Obligation, it is agreed as follows: <br />Performance Deed of Trust <br />
