IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2019-007 <br />RESOLUTION OF THE SAN LEANDRO CITY COUNCIL TO APPROPRIATE UP TO <br />$542,000 FOR THE IMPLEMENTATION OF PHASE III OF THE AIRPORT NOISE <br />INSULATION PROGRAM FOR THE DAVIS WEST NEIGHBORHOOD AND TO <br />AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE A SOLE <br />SOURCE CONSULTING SERVICES AGREEMENT WITH C. KELL-SMITH & <br />ASSOCIATES OR RELATED SUB -CONSULTANTS IN AN AMOUNT NOT TO <br />EXCEED $246,504 TO IMPLEMENT THE PROGRAM <br />WHEREAS, due to noise impacts generated by modifications made by the Port to <br />Oakland to the Oakland International Airport, the City entered into a settlement agreement with <br />the Port on December 5, 2000, with a related addendum adopted on July 22, 2003; and <br />WHEREAS, the above agreement facilitated implementation of noise impact mitigation <br />measures benefitting San Leandro residents within the Davis West, Mulford Gardens and <br />Timothy Lane neighborhoods through creation of the Airport Noise Insulation Program for up to <br />200 homes, and funded entirely by the Port of Oakland; and <br />WHEREAS, Phases I and II of the Program were managed via a consulting services <br />agreement with C. Kell -Smith & Associates, which completed improvements to 154 properties <br />before funding for the program was completed; and <br />WHEREAS, based on the sale of City -owned property at 2139 Laura Avenue, the City <br />Council directed staff to create the Davis West Neighborhood Investment Program on October <br />16, 2017; and <br />WHEREAS, the City Council now desires to fiend a final Phase III of the Airport Noise <br />Insulation Program to complete additional insulation measures for the Davis West <br />Neighborhood; and <br />WHEREAS, to effectuate the above goal, the City Council directs the City Manager to <br />negotiate and enter into a contract with C. Kell -Smith & Associates in an amount not to exceed <br />$246,504 to implement Phase III of the Airport Noise Insulation Program; and <br />WHEREAS, due to the highly technical and specialized nature of this work, coupled <br />with their experience executing the prior two phases of this program, C. Kell -Smith & Associates <br />is uniquely qualified to complete the proposed Phase III of the program and so the City Council <br />desires that the City enter into a sole source agreement with this firm. <br />NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of San <br />Leandro: <br />1. That $542,000 received from the 2017 sale of the formerly City -owned property <br />at 2139 Laura Avenue and designated towards the Davis West Neighborhood <br />Investment Program is hereby appropriated into account number 010-14-021- <br />5240 for the purposes of implementing Phase III of the Airport Noise Insulation <br />
