3.0 ENVIRONMENTAL CHECKLIST <br />1388 Bancroft Avenue Project City of San Leandro <br />Initial Study/Mitigated Negative Declaration November 2018 <br />3.0-14 <br />Clean Air Act, the Clean Air Act Amendments, and the California Clean Air Act. The BAAQMD is responsible for preparing plans to attain ambient air quality standards in the air basin. <br />The BAAQMD develops regulations to improve air quality and protect the health and welfare of <br />Bay Area residents and their environment. BAAQMD rules and regulations applicable to the <br />project area include, but are not limited to, the following: <br />• Regulation 6, Rule 3, Wood-Burning Devices. 6-3-306 Requirements for New Building Construction: Effective November 1, 2016, no person or builder shall install a wood-burning <br />device in a new building construction (BAAQMD 2015). <br />• Regulation 8, Rule 3, Architectural Coatings. Except as provided in Sections 8-3-302, 303, 307, and 309, no person shall: (i) manufacture, blend, or repackage for sale within the <br />District; (ii) supply, sell, or offer for sale within the District; or (iii) solicit for application or apply <br />within the District, any architectural coating with a VOC content, as calculated pursuant <br />to Section 8-3-607, in excess of the corresponding limit specified in the following tables [VOC limit tables not shown here] (BAAQMD 2009b). <br />• Regulation 11, Rule 2, Asbestos Demolition, Renovation and Manufacturing. The purpose of <br />this rule is to control emissions of asbestos to the atmosphere during demolition, renovation, <br />milling, and manufacturing and establish appropriate waste disposal procedures (BAAQMD 1998). <br />Air Quality Attainment Plan <br />The BAAQMD adopted the Bay Area 2017 Clean Air Plan in April 2017, which addresses <br />nonattainment of the national 1-hour ozone standard in the SFBAAB. The Clean Air Plan establishes a program of rules and regulations directed at reducing air pollutant emissions and achieving <br />state (California) and national air quality standards. The plan’s pollutant control strategies are <br />based on the latest scientific and technical information and planning assumptions, updated <br />emission inventory methodologies for various source categories, and the latest population growth projections and vehicle miles traveled (VMT) projections for the region. The Clean Air Plan defines <br />a control strategy that the BAAQMD and its partners will implement to (1) reduce emissions and <br />decrease ambient concentrations of harmful pollutants; (2) safeguard public health by reducing exposure to air pollutants that pose the greatest health risk, with an emphasis on protecting the communities most heavily impacted by air pollution; and (3) reduce greenhouse gas emissions to <br />protect the climate. In addition to updating the previously prepared ozone plan, the Clean Air <br />Plan also serves as a multipollutant plan to protect public health and the climate. In its dual role as an update to the state ozone plan and a multipollutant plan, the Bay Area 2017 Clean Air Plan <br />addresses four categories of pollutants (BAAQMD 2017b): <br />• Ground-level ozone and its key precursors, ROG and NOx <br />• Particulate matter: primary PM2.5, as well as precursors to secondary PM2.5 <br />• Air toxics <br />• Greenhouse gases <br />The Clean Air Plan provides local guidance for the SIP, which includes the framework for air quality <br />basins to achieve attainment of the state and federal ambient air quality standards.
