rental or leasing of any of the separate interests in the common interest development to <br />a renter, lessee, or tenant, a statement describing the prohibition; and (x) If requested <br />by the prospective purchaser, a copy of the minutes of Owners meetings conducted <br />over the previous 12 months, that were approved by the Owners. <br />(C)Payment of Assessments. Each Owner shall pay when due all <br />Assessments levied in accordance with Article 12. <br />(D)Joint Ownership. In the event of joint ownership of any <br />Condominium, the obligations and liabilities of the multiple Owners under the Governing <br />Documents shall be joint and several. <br />ARTICLE 5 - EASEMENTS AND RIGHTS OF ENTRY <br />5.1 Rights of Entry and Use. Each Condominium and its Unit or the Common <br />Area, as the case may be, shall be subject to the following rights of entry and use: <br />(A)The right of the Association, or its agents, to enter any Unit, <br />Common Area and Exclusive Use Common Area to cure any violation or breach of the <br />Governing Documents, or to perform maintenance as described in Section 8.5, <br />provided that the Owner has received notice and a hearing as required by Section 7.4 <br />(except in the case of an emergency as reasonably determined by the Association or its <br />agents) and such Owner has failed to cure such violation within thirty (30) days after the <br />finding of such violation by the Association or, if such violation cannot reasonably be <br />cured within thirty (30) days, such Owner has failed to diligently take steps necessary to <br />cure such violation within thirty (30) days after the finding of such violation by the <br />Association; <br />(B)The right of the Association, or its agents to enter any of the Units <br />and Common Area, including Exclusive Use Common Area, to perform its obligations <br />and duties under this Declaration, including any obligations or duties with respect to <br />construction, maintenance or repair for the benefit of the Common Area or the Owners <br />in common; <br />(C)The Association’s rights of entry and cure shall be immediate in <br />case of an emergency, as reasonably determined by the Association, originating upon <br />or threatening any Unit or Exclusive Use Common Area, whether or not its Owner is <br />present. For all non-emergency entry purposes except as provided in Section 5.1(A), <br />the Association or its agents shall furnish the Owner or his or her lessee with at least <br />forty-eight (48) hours’ written notice of its intent to enter the Unit or Exclusive Use <br />Common Area, specifying the purpose and scheduled time of such entry and shall <br />make every reasonable effort to perform its work and schedule its entry in a manner <br />that respects the privacy of the persons residing within the Unit; and <br />(D)Any easements as shown on the Map. <br />5.2 Support, Maintenance and Repair Easement.
