IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2019-044 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE <br />AND AUTHORIZE THE CITY MANAGER TO EXECUTE CONSULTING <br />SERVICES AGREEMENTS WITH NBS FOR SERVICES RELATED TO THE <br />FORMATION OF SPECIAL FINANCING DISTRICTS FOR EDEN ROAD, <br />PROJECT 210-38-295 AND NEPTUNE DRIVE SHORELINE FLOOD <br />PROJECTION, PROJECT 2016.0700; TO AUTHORIZE THE CITY MANAGER TO <br />NEGOTIATE AND APPROVE INDIVIDUAL AMENDMENTS UP TO 10% OF THE <br />ORIGINAL CONTRACT AMOUNTS; AND TO AUTHORIZE THE CITY <br />MANAGER TO NEGOTIATE AND APPROVE CUMULATIVE AMENDMENTS UP <br />TO 20% OF THE ORIGINAL CONTRACT AMOUNTS; <br />WHEREAS, agreements between the City of San Leandro and NBS, copies of which are <br />attached, were presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, the City Manager recommends approval of said agreements. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That said agreements are hereby approved and execution by the City Manager is hereby <br />authorized; and <br />• That the City Manager or his designee is authorized to negotiate and approve individual <br />amendments up to 10% of the original contract amounts, each, and <br />• That the City Manager or his designee is authorized to negotiate and approve cumulative <br />amendments up to a maximum of 20% of the original contract amounts. <br />Introduced Councilmember Ballew and passed and adopted this 19th day of February 2019, <br />by the following vote: <br />Members of the Council: <br />AYES: Councilmembers Aguilar, Ballew, Cox, Hernandez, Lee, Lopez; Mayor Cutter (7) <br />NOES: None (0) <br />EXCUSED: None (0) <br />ATTEST: <br />e ' ' I.
