IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2019-045 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE <br />AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING <br />SERVICES AGREEMENT WITH NOLL & TAM ARCHITECTS FOR DESIGN <br />SERVICES FOR THE MULFORD-MARINA BRANCH LIBRARY, PROJECT <br />2018.2400; TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND <br />APPROVE INDIVIDUAL CONTRACT AMENDMENTS UP TO 5%; AND TO <br />AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE <br />CUMULATIVE CONTRACT AMENDMENTS UP TO 15% OF THE ORIGINAL <br />CONTRACT AMOUNT; (PROVIDES FOR DESIGN SERVICES FOR <br />REPLACEMENT OF THE EXISTING LIBRARY WITH A NEW FACILITY AT <br />THE SAME LOCATION) <br />WHEREAS, an agreement between the City of San Leandro and Noll & Tam Architects, a <br />copy of which is attached, was presented to this City Council; and <br />WHEREAS, the attached agreement is substantially different from the agreement between <br />the City of San Leandro and Noll & Tam Architects which was approved by Resolution 18-093; and <br />WHEREAS, the City Council is familiar with the scope of work; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />• That said agreement is hereby approved and execution by the City Manager is hereby <br />authorized; and <br />• That the authorization for the agreement pursuant to Resolution 18-093 is superseded by this <br />Resolution; and <br />• That the City Manager or his designee is authorized to negotiate and approve individual <br />contract amendments up to a maximum of $18,302, which is 5% of the original contract <br />amount; and <br />• That the City Manager or his designee is authorized to negotiate and approve cumulative <br />contract amendments up to a maximum of $54,907, which is 15% of the original contract <br />amount, for a total not to exceed amount of $420,954; and <br />• That an original executed agreement shall be attached to and made a part of this resolution. <br />
