IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2019-045 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH NOLL & TAM ARCHITECTS FOR DESIGN SERVICES FOR THE MULFORD-MARINA BRANCH LIBRARY, PROJECT 2018.2400; TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE INDIVIDUAL CONTRACT AMENDMENTS UP TO 5%; AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE CUMULATIVE CONTRACT AMENDMENTS UP TO 15% OF THE ORIGINAL CONTRACT AMOUNT; (PROVIDES FOR DESIGN SERVICES FOR REPLACEMENT OF THE EXISTING LIBRARY WITH A NEW FACILITY AT THE SAME LOCATION) WHEREAS, an agreement between the City of San Leandro and Noll & Tam Architects, a copy of which is attached, was presented to this City Council; and WHEREAS, the attached agreement is substantially different from the agreement between the City of San Leandro and Noll & Tam Architects which was approved by Resolution 18-093; and WHEREAS, the City Council is familiar with the scope of work; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: • That said agreement is hereby approved and execution by the City Manager is hereby authorized; and • That the authorization for the agreement pursuant to Resolution 18-093 is superseded by this Resolution; and • That the City Manager or his designee is authorized to negotiate and approve individual contract amendments up to a maximum of $18,302, which is 5% of the original contract amount; and • That the City Manager or his designee is authorized to negotiate and approve cumulative contract amendments up to a maximum of $54,907, which is 15% of the original contract amount, for a total not to exceed amount of $420,954; and • That an original executed agreement shall be attached to and made a part of this resolution.
