Wang and Yan B. You ("Owners"), hereby place on the property ("Property") a <br />restrictive covenant that restricts the use of the Property for a specific land use activity. The land <br />use restrictive covenant placed on the Property shall run with the Property and thus impose <br />restrictions on all future owners and tenants unless a Notice of Release is executed and recorded <br />by the City of San Leandro ("City") <br />CONDITIONS OF USE OF STRUCTURES <br />NOW THEREFORE, in consideration of the mutual benefits, promises and agreements set out <br />herein, the parties agree as follows: <br />1. Scope of Project. The parties hereto agree that execution of this Declaration by Owners <br />and City entitles the owner to construct a rear addition to the existing single-family <br />dwelling, as approved by Permit Number B 18-2102. The addition will include a new <br />living room, one bedroom, an office, a playroom, and a bathroom. <br />2. Permitted Use of Addition. Owner agrees that the addition shall serve as part of the <br />single-family dwelling and shall not be used or rented as a separate dwelling unit. <br />3. One Residential Unit. Owners agree that the existing dwelling and addition shall <br />together be used as one single-family residential dwelling unit. The dwelling shall not <br />contain more than one kitchen at any time, unless and until the Owners have obtained all <br />permits required by the City for the creation of an accessory dwelling unit, and the <br />property and building(s) have met all zoning standards for accessory dwelling units, <br />including but not limited to standards for location, floor area, setbacks, and access, as <br />well as all applicable Building Code provisions. <br />4. Maximum of Four Bedrooms. Owners agree that the dwelling shall not contain more <br />than four bedrooms, unless and until the dwelling and property meet all zoning <br />requirements for a single-family dwelling, including but not limited to parking <br />requirements of Section 4-1704 of the San Leandro Zoning Code. <br />5. Compliance.
