City of San Leandro <br />Meeting Date: June 17, 2019 <br />Resolution - Council <br />Agenda Section:File Number:19-197 ACTION ITEMS <br />Agenda Number: <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Debbie Pollart <br />Public Works Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:RESOLUTION of the City of San Leandro City Council to Authorize the City <br />Manager to Execute a Thirteenth Letter Amendment of the Franchise Agreement <br />for Solid Waste, Recyclables, and Green Waste Services between the City of <br />San Leandro and Alameda County Industries, Inc. <br />WHEREAS, the City of San Leandro (“City”) and Alameda County Industries, Inc.(“ACI”), <br />executed that certain Franchise Agreement for Solid Waste, Recyclables, and Green Waste <br />Services between the City of San Leandro and Alameda County Industries, Inc., dated February <br />1, 2000 (“Franchise Agreement”); and <br />WHEREAS, the Franchise Agreement has been amended by the City and ACI from time <br />to time; and <br />WHEREAS, a Thirteenth Letter Amendment to the Franchise Agreement between the City <br />of San Leandro and Alameda County Industries (ACI), Inc., a copy of which is attached, has been <br />presented to this City Council; and <br />WHEREAS, pursuant to the Thirteenth Letter Amendment, ACI will be authorized to <br />implement a 7.89% rate increase for all rates effective October 1, 2019; and <br />WHEREAS, pursuant to the Thirteenth Letter Amendment, the Parties will discuss a new <br />rate adjustment process and consider an amendment to the Agreement accordingly prior to any <br />rate adjustment under Amendment 10, effective July 1, 2020; and <br />WEREAS, pursuant to the Thirteenth Letter Amendment, such amendment to the <br />Agreement will be brought before the San Leandro City Council for approval before February 1, <br />2020; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />Page 1 City of San Leandro Printed on 6/12/2019 <br />290
