City of San Leandro <br />Meeting Date: July 15, 2019 <br />Resolution - Council <br />Agenda Section:File Number:19-373 PUBLIC HEARINGS <br />Agenda Number: <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Debbie Pollart <br />Public Works Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:RESOLUTION of the City of San Leandro City Council to Amend Title 12, <br />Chapter 5, Section 12.5.115 of the City of San Leandro Administrative Code to <br />Clarify When and How Capacity Fees May Change <br />WHEREAS, the City Council may need to change the date that Capacity Fees are <br />adjusted; and <br />WHEREAS, the ENR-20 City Index published by Engineering News-Record is a more <br />accurate representation of growth of facility value; and <br />WHEREAS, the City Council may need to adjust Capacity Fees by other than the Index <br />amount; and <br />WHEREAS, City Staff may need to forgo adjusting fees after one year of service. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. Title 12, Chapter 5, Section 12.5.115 of the City of San Leandro Administrative <br />Code is hereby amended according to Exhibit A, attached hereto and made a part of this <br />resolution; and <br />2. The City Council declares that the aforementioned amendment to Title 12, <br />Chapter 5, Section 12.5.115 of the San Leandro Administrative Code shall take effect <br />immediately. <br />Page 1 City of San Leandro Printed on 7/9/2019 <br />190
