City of San Leandro <br />Meeting Date: July 15, 2019 <br />Resolution - Council <br />Agenda Section:File Number:19-410 CONSENT CALENDAR <br />Agenda Number: <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Tom Liao <br />Community Development Director <br />FINANCE REVIEW:David Baum <br />Finance Director <br />TITLE:RESOLUTION of the City of San Leandro City Council to Approve Amendment <br />No. 3 to the Consulting Services Agreement for Third Party Plan Check Services <br />Between the City of San Leandro and TRB+Associates (to increase the contract <br />by $38,000 for an amount not to exceed $306,000) <br />WHEREAS, the original consulting services agreement (CSA) between the City of San <br />Leandro and TRB+Associates in an amount not to exceed $150,000 was presented to and <br />approved by this City Council on June 18, 2018; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, amendments to the agreement to clarify the work or respond to atypical <br />existing conditions are a normal aspect of public contracting and procurement of services; and <br />WHEREAS, in order to expedite the third party plan check projects on schedule and on <br />budget, provide that the consultants are paid in a timely fashion, avoid as much as possible costly <br />delay claims, and ensure that the City completes projects according to the City’s highest <br />standards, the City Council finds that providing authorization to the City Manager or his or her <br />designee to negotiate amendments to the consulting services agreement is in the best interest of <br />public welfare; and <br />WHEREAS, the City Manager, as authorized by City Council to administratively approve <br />amendments up to 25% of the original contract amount, approved Amendment No. 1 to the CSA <br />with TRB+Associates to increase the contract by $37,500 for an amount not to exceed $187,500 <br />in March 2019; and <br />WHEREAS, the City Council approved on April 15, 2019 Amendment No. 2 to the CSA <br />with TRB+Associates to increase the contract by $80,500 for an amount not to exceed $268,000; <br />and <br />Page 1 City of San Leandro Printed on 7/9/2019 <br />421
