IN THE CITY COUNCIL OFTI-JE CITY OF SAN I.,EANDRO <br />RESOLUTION NO. 2019-129 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO AUTHORIZE <br />THE CITY MANAGER TO EXECUTE A NON-PROFESSIONAL SERVICES AGREEMENT <br />WITH MATRIX HG, INC. FOR POOL BOILER REPLACEMENT AT THE SAN LEANDRO <br />FAMILY AQUATIC CENTER (WASHINGTON MANOR PARK) IN THE AMOUNT OF S66,296, <br />AND TO NEGOTIATE AND APPROVE CUMULATIVE CHANCE ORDERS UP TO 25% OF <br />THE ORIGINAL CONTRACT AMOUNT <br />WHEREAS, a draft agreement between the City of San Leandro and Matrix HG, Inc. was <br />presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof, and <br />WHEREAS, Change Orders to modify bid quantities or to respond to unexpected conditions are a <br />normal aspect Of public contracting and construction; and <br />WHEREAS, in order to deliver quality public works projects on schedule and within budget, the <br />Council finds that authorizing approval of Change Orders is in the best interests of'public health, safety and <br />welfare; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br />That said agreement substantially in the lorm presented is hereby approved and execution by the <br />City Manager is hereby authorized; and <br />That the City Manager is authorized to make non -substantial revisions to said agreement, subject to <br />the approval of the City Attorney; and <br />'['hat the City Manager or his designee is authorized to negotiate and approve Cumulative change <br />orders tip to a maximum of$] 6,574, which is 25% of the original contract amount; and <br />0 That an original executed agreement shall be attached to and made apart of this resolution. <br />Introduced by Councilitiember Aguilar and passed and adopted this 15tli day of Judy 2019, by the <br />following vote: <br />Members of the Council: <br />AYES: Counci Irnembers Aguilar, Bal lew, Cox, I lernandez., Lee, Lopez; Mayor Cutter (7) <br />NOF"S: None (0) <br />ABSENT: None z <br />ATTEST: <br />LCU44, I.
