City of San Leandro <br />Meeting Date: September 3, 2019 <br />Ordinance <br />Agenda Section:File Number:19-375 CONSENT CALENDAR <br />Agenda Number:8.R. <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Debbie Pollart <br />Public Works Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:ORDINANCE of the City of San Leandro to Amend Title 3, Chapter 3, Section <br />3-14-800 of the City of San Leandro Municipal Code Relating to Wastewater <br />Charges and Fees <br />The City Council of the City of San Leandro recites the following: <br />WHEREAS, at the City Council Meeting on May 6, 2019, the City Council accepted a <br />Wastewater Utility Financial Plan and Rates Study (“Study”); and <br />WHEREAS, this Study found that the characteristics of domestic wastewater have changed; <br />and <br />WHEREAS, some measures of wastewater characteristics are no longer in use. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: <br />SECTION 1. PURPOSE. The purpose of this ordinance is to amend the San Leandro <br />Municipal Code to reflect current and accurate measures of domestic wastewater characteristics <br />and reflect characteristics currently in use. <br />SECTION 2. AMENDMENT OF CODE. Title 3, Chapter 3-14, Section 3-14-800 of the <br />San Leandro Municipal Code is hereby amended as shown in Exhibit A, attached hereto and <br />incorporated herein by reference. <br />SECTION 3. SEVERABILITY. If any section, subsection, subdivision, paragraph, <br />sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, is <br />for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not <br />affect the validity or enforceability of the remaining sections, subsections, subdivisions, <br />paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any other <br />person or circumstance.
