The Zoning Enforcement Official may require <br />such evidence of ability to comply with performance standards as he deems <br />necessary prior to issuance of a zoning permit or any other required permit. <br />4-1672 Earth Station and Microwave Equipment <br />A. Purpose. To ensure that amateur radio antennas and satellite and <br />microwave dish earth stations and equipment do not have an adverse <br />impact on aesthetic values and public safety in residential, commercial, and <br />industrial areas, installation of these earth stations and equipment is <br />governed by the following controls. The intent of these regulations is only to <br />locate such earth stations and equipment where they are least visible from <br />public rights-of-way in the vicinity, while not burdening adjacent property <br />owners with adverse visual impacts. The intent is not to discriminate <br />against dish earth stations in favor of other communications facilities. <br />B. Permit Required. A zoning permit shall be required for the installation of <br />amateur radio antennas, a satellite or microwave-receiving earth station, <br />and a use permit shall be required for the installation of microwave <br />transmitting and relay equipment. In considering a permit application, the <br />Zoning Enforcement Official or Board of Zoning Adjustments shall balance <br />the imposition of all applicable codes, regulations, and standards of the City <br />of San Leandro with the applicant's right to receive satellite transmissions <br />without unreasonable limitations on transmission reception or the imposition <br />of costs which are excessive in light of the purchase cost of the equipment. <br />C.Locational Criteria: Amateur Radio. An amateur radio antenna may be <br />installed on a lot in any district if it complies with the following criteria: <br />1.Setbacks. Five (5) feet from interior side or rear property line. <br />2.Maximum Height. Ten (10) feet above the district height limit, provided <br />that additional height may be authorized with a use permit. <br />3.Surface Materials and Finishes. Highly reflective surfaces shall not be <br />permitted. <br />D.Locational Criteria: Satellite. A satellite earth station may be installed on a <br />lot in any zoning district if it complies with the following criteria: <br />1.Placement on Lot: The preferred placement of a satellite earth station <br />shall be in the rear yard or interior side yard of a given parcel, no closer <br />than five (5) feet to the side or rear property line, or to the front street- <br /> AR.16 <br />Page 18 of 46 <br /> <br />
