File Number: 19-539 <br />WHEREAS, the development of the 20 townhome units is located entirely within the areas <br />to be rezoned CC(PD) Commercial Community, Planned Development Overlay; <br />WHEREAS, the Planned Development Project complies with the minimum area, width, <br />residential unit density, height, coverage, floor area ratio, and landscaping standards required <br />under the base district zoning regulations; <br />WHEREAS, a Planned Development establishes a discretionary review process that <br />enables consideration of a new development that is otherwise compatible with the existing <br />neighborhood and complies with the General Plan, but may not meet all of the underlying zoning <br />standards; <br />WHEREAS, a Consistency Memorandum was prepared in accordance with CEQA <br />Guidelines, California Code of Regulations Section 15183, with the finding that the Proposed <br />Project is consistent with a Community Plan or Zoning, that there are no project-specific <br />significant effects which are peculiar to the project or its site, and therefore no additional <br />environmental review is required. The existing building proposed for demolition with the project <br />was evaluated and cleared in conjunction with the CEQA Consistency Memorandum. <br />WHEREAS, a staff report for the City of San Leandro Planning Commission dated <br />September 5, 2019 and incorporated herein by reference, described and analyzed the proposed <br />rezoning; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the rezoning <br />on September 5, 2019, at which time all interested parties had the opportunity to be heard; and <br />WHEREAS, the Planning Commission fully considered the Project application and <br />entitlements, staff report, findings of fact, conditions of approval, public comments, and all other <br />testimony and evidence presented at the public hearing prior to making a recommendation on the <br />zoning amendment and planned development. <br />WHEREAS, following the public hearing, the Planning Commission adopted Resolution <br />No. 2019-009 based on findings of fact, recommending that the City Council approve the Project. <br />Planning Commission Resolution No. 2019-009 is dated September 5, 2019 and incorporated <br />herein by reference; and <br />WHEREAS, a staff report dated October 21, 2019 and incorporated herein by reference, <br />analyzed the Project, including the rezoning. On October 21, 2019, the City Council held a duly <br />noticed public hearing on the Project, at which time all interested parties had the opportunity to be <br />heard; and <br />WHEREAS, the City Council considered all above-referenced reports, recommendations, <br />and testimony prior to taking action on the Zoning Amendment and Planned Development <br />overlay. <br />NOW, THEREFORE, the City Council of the City of San Leandro does hereby ORDAIN <br />Page 2 City of San Leandro Printed on 10/30/2019 <br />189
