IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2019-160 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH TERRAPHASE ENGINEERING, INC., IN THE AMOUNT NOT TO EXCEED $789,036 FOR DESIGN AND PERMITTING SERVICES OF A NEW TREATMENT WETLAND AT THE WATER POLLUTION CONTROL PLANT; AUTHORIZE THE CITY MANAGER TO EXECUTE CONTRACT AMENDMENTS UP TO 20% (OR $157,807) AND AN APPROPRIATION OF THE WATER POLLUTION CONTROL PLANT ENTERPRISE FUND BALANCE IN THE AMOUNT OF $501,917 FOR FISCAL YEAR 2019-20 WHEREAS, City staff sought competitive proposals for design and permitting services for the Treatment Wetland Project and Terraphase Engineering, Inc.'s proposal provides the best value and is the most advantageous to the City; and WHEREAS, an agreement between the City and Terraphase Engineering, Inc., a copy of which is attached hereto and incorporated herein by reference, was presented to the City Council; and WHEREAS, the City Council is familiar with the contents thereof and desires to award a contract to Terraphase Engineering, Inc. for design and permitting services for a Treatment Wetland at the Water Pollution Control Plant; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That for Fiscal Year 2019-20 an additional appropriation of fiends shall be made from the Water Pollution Control Plant Fund balance in the amount of $501,917 to account 593-52-276-5120; and 2. That the expenditure of these funds to pay for design and permitting of a treatment wetland is authorized; and 3. That the City Council awards the agreement, substantially in the form presented, to Terraphase Engineering, Inc. in the amount not to exceed $789,036 and the City Manager is authorized to execute the agreement; and 4. That the City Manager is authorized to negotiate amendments not to exceed a total of 20% (or $157,807) of the not -to -exceed amount; and 5. That the City Manager is authorized to make non -substantial revisions to said agreement, subject to the approval of the City Attorney; and 6. That an original executed agreement shall be attached to and made part of this resolution.
