IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2019-160 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE <br />AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING <br />SERVICES AGREEMENT WITH TERRAPHASE ENGINEERING, INC., IN THE <br />AMOUNT NOT TO EXCEED $789,036 FOR DESIGN AND PERMITTING SERVICES <br />OF A NEW TREATMENT WETLAND AT THE WATER POLLUTION CONTROL <br />PLANT; AUTHORIZE THE CITY MANAGER TO EXECUTE CONTRACT <br />AMENDMENTS UP TO 20% (OR $157,807) AND AN APPROPRIATION OF THE <br />WATER POLLUTION CONTROL PLANT ENTERPRISE FUND BALANCE IN THE <br />AMOUNT OF $501,917 FOR FISCAL YEAR 2019-20 <br />WHEREAS, City staff sought competitive proposals for design and permitting services for <br />the Treatment Wetland Project and Terraphase Engineering, Inc.'s proposal provides the best <br />value and is the most advantageous to the City; and <br />WHEREAS, an agreement between the City and Terraphase Engineering, Inc., a copy of <br />which is attached hereto and incorporated herein by reference, was presented to the City Council; <br />and <br />WHEREAS, the City Council is familiar with the contents thereof and desires to award a <br />contract to Terraphase Engineering, Inc. for design and permitting services for a Treatment <br />Wetland at the Water Pollution Control Plant; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That for Fiscal Year 2019-20 an additional appropriation of fiends shall be made from <br />the Water Pollution Control Plant Fund balance in the amount of $501,917 to account <br />593-52-276-5120; and <br />2. That the expenditure of these funds to pay for design and permitting of a treatment <br />wetland is authorized; and <br />3. That the City Council awards the agreement, substantially in the form presented, to <br />Terraphase Engineering, Inc. in the amount not to exceed $789,036 and the City <br />Manager is authorized to execute the agreement; and <br />4. That the City Manager is authorized to negotiate amendments not to exceed a total of <br />20% (or $157,807) of the not -to -exceed amount; and <br />5. That the City Manager is authorized to make non -substantial revisions to said <br />agreement, subject to the approval of the City Attorney; and <br />6. That an original executed agreement shall be attached to and made part of this <br />resolution. <br />
