City of San Leandro <br />311 MacArthur Boulevard Residential Project <br /> <br />76 <br />impacts, in order to maintain acceptable service ratios, response times or other performance <br />objectives? <br />a.2. Would the project result in substantial adverse physical impacts associated with the provision <br />of new or physically altered police protection facilities, or the need for new or physically altered <br />police protection facilities, the construction of which could cause significant environmental <br />impacts, in order to maintain acceptable service ratios, response times or other performance <br />objectives? <br />The General Plan EIR found less than significant impacts to fire and police protection facilities, as <br />future developments would comply with the San Leandro Municipal Code, the California Health and <br />Safety Code, California Fire Plan, and 2035 General Plan goals and policies regarding fire and police <br />protection services. Similarly, the proposed project would be required to comply with these laws, <br />regulations, goals, and policies. The project site is located within one mile of two fire stations and <br />one mile from the San Leandro Police Department, in an area already developed with commercial <br />and residential uses. The proposed project is generally similar to the surrounding uses, and would <br />not substantially increase demand on local fire stations such that new or physically altered police or <br />fire protection facilities would be required. Therefore, this impact would be less than significant. <br />LESS THAN SIGNIFICANT OR LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATED <br />a.3. Would the project result in substantial adverse physical impacts associated with the provision <br />of new or physically altered schools, or the need for new or physically altered schools, the <br />construction of which could cause significant environmental impacts, in order to maintain <br />acceptable service ratios or other performance objectives? <br />Impacts to local schools were determined to be less than significant in the General Plan EIR, as <br />development impact fees required by the school districts, as well as compliance with 2035 General <br />Plan goals and policies would adequately reduce impacts from additional students generated by <br />future development. Based on the 0.35 per housing unit student generation rate provided in the <br />General Plan EIR, the proposed project would result in seven new students in the San Leandro <br />Unified School District. This seven-student increase is within the General Plan EIR’s estimated 1,985 <br />student increase at 2035 General Plan buildout. Additionally, the project applicant would be <br />required to pay development impact fees that would be used by the local school district to mitigate <br />impact associated with long-term operation and maintenance of school facilities. Pursuant to <br />Section 65996(3)(h) of the California Government Code, payment of these fees “is deemed to be full <br />and complete mitigation of impacts of any legislative or adjudicative act, or both, involving but not <br />limited to, the planning, use, or development of real property, or any change in government <br />organization or reorganization.” The project would therefore have a less than significant impact that <br />would not be greater than that analyzed in the General Plan EIR. <br />LESS THAN SIGNIFICANT OR LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATED <br />a.4. Would the project result in substantial adverse physical impacts associated with the provision <br />of new or physically altered parks, or the need for new or physically altered parks, the <br />construction of which could cause significant environmental impacts, in order to maintain <br />acceptable service ratios or other performance objectives? <br />Please refer to Section 16, Recreation. <br />LESS THAN SIGNIFICANT OR LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATED
