City of San Leandro <br />Meeting Date: March 16, 2020 <br />Staff Report <br />Agenda Section:File Number:19-682 ATS Review <br />Agenda Number:8.C. <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Tom Liao <br />Community Development Director <br />FINANCE REVIEW:Liz Warmerdam <br />Interim Finance Director <br />TITLE:Staff Report for a City Council Resolution Approving a Consulting Services <br />Agreement with Miller Planning Associates to Prepare Objective Residential and <br />Mixed-Use Design and Development Standards and Authorizing the City <br />Manager to Execute a Consulting Services Agreement with Miller Planning <br />Associates with a Not to Exceed amount of $310,000 (from the State Housing <br />and Community Development Department’s SB 2 Planning Grant Program) <br />SUMMARY AND RECOMMENDATIONS <br />Staff recommends that the City Council authorize the City Manager to enter into a consulting <br />services agreement (CSA) with Miller Planning Associates to prepare objective residential and <br />mixed-use design and development standards funded by the City of San Leandro’s SB 2 <br />Planning Grant award from the State Housing and Community Development Department (HCD). <br />The not-to-exceed amount of $310,000 will be for the time period ending June 30, 2022. <br />BACKGROUND <br />In 2017, Senate Bill 35 (SB 35) was signed by the Governor establishing a mandated, ministerial <br />(streamlined) review process for multi-family residential projects under specific conditions and <br />near transit locations. To qualify for this process, an applicant would be required to pay prevailing <br />wage for construction labor and meet the affordable housing production threshold. This law <br />exempts such projects from environmental (CEQA) review and limits the local government <br />agency’s project review to locally adopted “objective design and development standards.” <br />Also in 2017, Governor Brown signed Senate Bill 2 (SB 2), titled the “Building Homes and Jobs <br />Act,” which specifically established a permanent, on-going source of funding dedicated to <br />promoting and facilitating affordable housing development. On March 28, 2019, HCD released a <br />Notice of Funding Availability (NOFA) for approximately $123 million in revenue earmarked for <br />local government planning grants. Under this grant program, local governments are provided an <br />eligibility allowance based on community population.
