G. Developer has agreed to cooperate with the City in the formation of a Community <br />Facilities District (the "District") under the Mello -Roos Community Facilities Act of 1982 <br />(Government Code § 53311 et. seq.). Developer agrees that the District shall include all of the <br />Property and any improvements constructed thereon. Special taxes derived from the District will <br />be used to pay for public area maintenance, public area utilities, reserves and capital expenditures <br />for public infrastructure, and administration of the District. <br />H. City has determined that by entering into this Development Agreement: (1) City <br />will ensure the productive use of property and foster orderly growth and quality development in <br />the City; (2) development will proceed in accordance with the goals and policies set forth in the <br />City of San Leandro General Plan (the "General Plan") and will implement City's stated General <br />Plan policies; (3) City will receive increased tax revenues; and (4) City will benefit from <br />increased housing, lodging, restaurant, employment, economic and recreational opportunities for <br />residents and businesses of the City that are created by the Project. <br />I. City has undertaken, pursuant to the California Environmental Quality Act <br />(Public Resources Code Section 21000 et seq., hereinafter "CEQA"), the required analysis of the <br />environmental effects that would be caused by the Project and has determined those feasible <br />mitigation measures which will eliminate, or reduce to an acceptable level, the adverse <br />environmental impacts of the Project. The environmental effects of the proposed development of <br />the Property were analyzed by the Final Environmental Impact Report (the "FEIR") certified by <br />Resolution 2015-125, adopted by the City Council on July 20, 2015. City has also adopted a <br />mitigation monitoring and reporting program (the "MMRP") to ensure that those mitigation <br />measures incorporated as part of, or imposed on, the Project are enforced and completed. Those <br />mitigation measures for which Developer is responsible are incorporated into, and required by, <br />the Project Approvals. The City adopted an addendum to the FEIR (the "FEIR Addendum") <br />based upon changes in the Project after the FEIR was certified by the City Council. The FEIR <br />Addendum was certified by Resolution adopted by the City Council on February 24, <br />2020. <br />J. The use and development of the Property pursuant to this Agreement will provide <br />substantial employment and property tax benefits, and contribute to the provision of needed <br />infrastructure, recreational facilities, and housing for area growth, thereby achieving the goals and <br />objectives of the City. This Agreement will provide for the development of the Shoreline area <br />with a resilient and self-sustaining mix of housing, recreation, public amenities and hospitality <br />consistent with the vision of the City's General Plan. <br />K. The City Council finds that the economic interests of City's residents and the <br />public health, safety and welfare will be best served by entering into this Agreement. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises set forth <br />herein, City and Developer agree as follows: <br />
