Mobile Home Park. An area of land where two or more mobile home sites are rented or <br />held out for rent to accommodate mobile homes used for human habitation. Mobile home <br />park shall not include a mobile home subdivision or stock cooperative. <br />Mobile Home Park Conversion. A use of a mobile home park for a purpose other than the <br />rental or the holding out for rent of two or more mobile home sites to accommodate mobile <br />homes used for human habitation. Such a conversion may affect an entire mobile home <br />park or any portion thereof. A conversion shall include, but is not limited to, a change of the <br />mobile home park or any portion thereof to a condominium, stock cooperative, planned unit <br />development, or any form of ownership wherein spaces within the mobile home park are to <br />be sold. <br />Mortuaries. Establishments where dead bodies are kept until burial. This classification in- <br />cludes funeral homes, but excludes cremation. <br />Multi -Family Residential. Three or more dwelling units in a single building on a site. <br />Municipal Code. The Municipal Code of the City of San Leandro, as amended. <br />Neighborhood/Specialty Food Markets. Neighborhood grocery stores, and stores special- <br />izing in particular or distinctive food items, including, but not limited to, retailers whose primary <br />business maintains a wide inventory of gourmet, health, or ethnic food items not commonly <br />found in area supermarkets or convenience stores. This classification also includes delicates- <br />sens, confectioneries, full service bakeries, butcher, fish and poultry shops, and produce mar- <br />kets, and may also include a sandwich shop as an accessory use. Also see "Convenience <br />Stores." <br />Nonconforming Structure. A structure, which was lawfully erected but that does not con- <br />form to the development standards for lot coverage, setbacks, height, number of stories, <br />distance between structures, or floor area ratio prescribed in the regulations for the district <br />in which the structure is located by reason of adoption or amendment of this Code or by <br />reason of annexation of territory to the City. <br />Nonconforming Use. A use of a structure or land, which was lawfully established and <br />maintained, but that does not conform with the use regulations for the district in which it is <br />located by reason of adoption or amendment of this Code or by reason of annexation of <br />territory to the City. A use that does not conform to the parking or loading regulations appli- <br />cable to the district in which it is located shall not be considered a nonconforming use solely <br />because of one or more of these nonconformities. <br />Nonhabitable Accessory Structure. A detached subordinate structure without living <br />space, the use of which is appropriate, subordinate and customarily incidental to that of the <br />main structure or the main use of the land and which is located on the same site with the <br />main structure or use. <br />Page 37 of 459 <br />City Council Hearing March 2, 2020 <br />
