City of San Leandro <br />Meeting Date: March 23, 2020 <br />Urgency Ordinance <br />Agenda Section:File Number:20-127 ACTION ITEMS <br />Agenda Number: <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Tom Liao <br />Community Development Director <br />FINANCE REVIEW:Liz Warmerdam <br />Interim Finance Director <br />TITLE:AN URGENCY ORDINANCE of the City of San Leandro under San Leandro <br />Municipal Code Section 1-1-345(b) Enacting a Temporary Moratorium on <br />Evictions Due to Nonpayment of Rent for Residential and Commercial Tenants <br />Where the Failure to Pay Rent is from Income Loss Resulting from the Novel <br />Coronavirus (COVID-19) <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />WHEREAS, international, national, state, and local health and governmental authorities are <br />responding to an outbreak of respiratory disease caused by a novel coronavirus named <br />“SARS-CoV-2,” and the disease it causes has been named “coronavirus disease 2019,” <br />abbreviated COVID-19 (“COVID-19”); and <br />WHEREAS, on January 30, 2020, the World Health Organization (“WHO”) declared COVID-19 a <br />Public Health Emergency of International Concern, and on January 31, 2020, the United States <br />Secretary of Health and Human Services declared a Public Health Emergency; and <br />WHEREAS, on January 23, 2020 the CDC activated its emergency response system to provide <br />ongoing support for the response to COVID-19 in the United States; and <br />WHEREAS, on January 31, 2020, the Secretary of the United States Department of Health and <br />Human Services declared a public health emergency for the entire United States to aid the <br />nation’s healthcare community in responding to COVID-19; and <br />WHEREAS, on February 25, 2020, the Centers for Disease Control and Prevention announced <br />that community spread of COVID-19 is likely to occur in the United States; and <br />WHEREAS, on March 1, 2020, the Health Officer of Alameda County declared a public health <br />emergency throughout the County of Alameda; and <br />WHEREAS, on March 4, 2020, the Governor of California proclaimed a state of emergency <br />Page 1 City of San Leandro Printed on 3/20/2020 <br />9
