IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2020-031 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE A CONSULTING SERVICES AGREEMENT WITH NICHOLS CONSULTING ENGINEERS (NCE) FOR THE DESIGN OF THE ANNUAL STREET OVERLAYIREHABILITATION 2019-21, PROJECT NO. 2020.0050 FOR AN AMOUNT NOT TO EXCEED $691,511; TO AUTHORIZE FOR INDIVIDUAL AGREEMENT AMENDMENTS UP TO (10%) (OR $69,151); AND TO AUTHORIZE CUMULATIVE AGREEMENT AMENDMENTS UP TO 15% (OR $103,726) (PROVIDES AUTHORIZATION FOR THE CITY MANAGER TO ENTER INTO A CSA WITH NCE TO PREPARE THE SURVEYS AND DESIGNS FOR THE ANNUAL STREET OVERLAYIREHABILITATION 2019-21 PROJECT) WHEREAS, the City Council has indicated that streets are a critical component of the City's infrastructure and their condition is an important factor in the quality of life for residents and the vitality of local businesses; and WHEREAS, the City Council has approved the City Budget which contains the Capital Improvement Program and the Annual Street Overlay/Rehabilitation 2019-2021 Project; and WHEREAS, the City Council has directed the City Manager and his designees to improve the conditions of the streets. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said City Council hereby authorizes the City Manager to reject all of said proposals except that herein mentioned; negotiate, approve, and execute the agreement for topographic survey and civil engineering design services with NCE for an amount not to exceed $691,511; and That the City Manager or his designee is authorized to negotiate and approve individual agreement amendments to the consulting services agreement up to 10% (or $69,151) of the original agreement amount; and That the City Manager or his designee is authorized to negotiate and approve agreement amendments to the consulting services agreement up to a cumulative value not to exceed 15% (or $103,726) of the original agreement amount.
