44 <br /> <br />utility moratorium, is in effect; (ii) the actions of public agencies that regulate land use, <br />development or the provision of services to the Property prevent, prohibit or delay either the <br />construction, funding or development of the Project or (iii) there is any mediation, arbitration; <br />litigation or other administrative or judicial proceeding pending involving the Project Approvals. <br />Furthermore, in the event the issuance of a building permit for any part of the Project is delayed <br />as a result of Developer’s inability to obtain any other required permit or approval due to delays <br />caused by City or other governmental agencies, then the Term of this Agreement shall be <br />extended by the period of any such delay. <br />9.3.
