<br />-22- <br />15966623.2 <br />estimated to be necessary in each such estimated annual budget, or to collect such charges from <br />the taxpayers, landowners, or users of any of the Facilities. <br />Section 14. Records and Accounts <br />The Authority will cause to be kept accurate and correct books of account, showing in <br />detail the costs and expenses of any construction and the maintenance, operation and <br />administration of the Facilities and all financial transactions of the Agencies relating to the <br />Facilities, which books of account will correctly show any receipts and also any costs, expenses, <br />or charges to be paid by all or any of the Agencies hereunder, and also records of the effluent <br />flow from each of the Agencies. Time records and books of account will be open to inspection at <br />all times by any representative of any of the Agencies, or by any accountant or other person <br />authorized by any Agency to inspect said books of account. <br />Section 15. Income from Operations <br />Income arising out of the operation of the Facilities, including the sale of recycled water, <br />will be retained as part of the fund balance in the fund in which it is earned. Any interest earned <br />on the fund balance will also be retained in the fund. The fund balance may be used as an <br />operating reserve or, upon approval of the Commission, to fund additional study, design or <br />construction, or upon approval by the Commission may be refunded to the Agencies on the basis <br />of the Fixed Operation and Maintenance Costs allocation in accordance with Schedule B. <br />Income from the lease of capacity rights, sale of services or assets, or connection fees <br />will be deposited in the Renewal and Replacement Fund. <br />Section 16. Failure to Meet Discharge Requirements <br />(a) Capacity Exceedance. <br />If the Authority experiences an unpermitted discharge or other violation due to high <br />flows caused by one or more Agencies' exceedance of the Maximum Flow Rate Capacity as <br />detailed in Section 11(b), any fines or other sanctions or costs imposed on the Authority will be <br />allocated to the exceeding Agency(ies) based on an instantaneous (defined as a 5–minute) <br />exceedance.
