Page 14 <br /> <br />CDBG LOAN AGREEMENT <br />BETWEEN THE CITY OF SAN LEANDRO AND <br />BUILDING FUTURES FOR WOMEN AND CHILDREN <br /> ii. Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251, et seq. as <br />amended; Section 1318 relating to inspection, monitoring, entry, reports, and <br />information, as well as other requirements specified in said Section 114 and <br />Section 308, and all regulations and guidelines issued thereunder. <br /> <br /> iii. Environmental Protection Agency (EPA) regulations pursuant to 40 C.F.R., <br />Part 50, as amended. <br /> <br /> iv. National Environmental Policy Act of 1969. <br /> <br /> v. HUD Environmental Review Procedures (24 CFR, Part 58). <br /> <br /> vi. California Environmental Quality Act. <br /> <br /> 6.12.2. Flood Disaster Protection <br /> <br /> Participant agrees to comply with the requirements of the Flood Disaster Protection Act of 1973 <br />(P.L. 2234) in regard to the sale, lease, or other transfer of land acquired, cleared or improved <br />under the terms of this agreement, as it may apply to the provisions of this agreement. <br /> <br /> 6.12.3. Historic Preservation <br /> <br /> If applicable, Participant agrees to comply with the Historic Preservation requirements set forth <br />in the National Historic Preservation Act of 1966, as amended (16 U.S.C. 470) and the <br />procedures set forth in 36 CFR, Part 800, Advisory Council on Historic Preservation Procedures <br />for Protection of Historic properties. <br /> <br /> In general and if applicable, the City or Participant shall obtain concurrence from the State <br />Historic Preservation Officer for all rehabilitation and demolition of properties that are fifty years <br />old or older or that are included on a Federal, State, or local historic property list. <br /> <br /> 6.12.4. Reserved. <br /> <br /> 6.13. Reserved. <br /> <br /> 6.14. PROGRAM ACCESSIBILITY <br /> <br />To the extent applicable, Participant shall construct the Improvements in compliance with all applicable <br />federal and state disabled persons accessibility requirements including but not limited to the Federal Fair <br />Housing Act; Section 504 of the Rehabilitation Act of 1973 (“Section 504”); Title II and/or Title III of the <br />Americans with Disabilities Act; and Title 24 of the California Code of Regulations (collectively, the <br />“Accessibility Requirements”). In compliance with Section 504 Participant shall provide the City with a <br />certification from the Improvements architect that to the best of the architect's knowledge, the <br />Improvements comply with all federal and state accessibility requirements applicable to the Improvements. <br />Participant shall indemnify, hold harmless and defend (with counsel reasonably acceptable to the City) the <br />373
