22 <br /> <br /> <br /> <br />cost of the system or significantly decrease its efficiency or specified performance, or which allow for an <br />alternative system of comparable cost, efficiency, and energy conservation benefits. <br /> <br />D. Governmental Approvals: All alterations, modifications, or other improvements on <br />or within the Project shall comply with all design requirements, approvals and procedures of the City. Before <br />commencement of any alteration or improvements approved by the Architectural Committee (as described <br />in Section 10.3 below) or Board, the Owner shall comply with all appropriate governmental laws and <br />regulations. Approval by the Architectural Committee or the Board does not satisfy the appropriate <br />approvals that may be required by any governmental entity with appropriate jurisdiction. <br /> <br />7.12. Activities Causing Increase in Insurance Rates: Nothing shall be done or kept on any Unit <br />or in any improvements constructed thereon or in the Common Area, which will increase any applicable <br />rate of insurance or which will result in the cancellation of insurance on any Unit or any part of the Common <br />Area, or which would be in violation of any law. <br /> <br />7.13. Maintenance of Units: Each Owner shall maintain and repair his or her Unit, or cause <br />such maintenance and repair to occur, in accordance with the Unit Maintenance Guidelines and the <br />provisions of Section 5.1.D, such that the Unit remains in all times in good condition and repair, in a <br />reasonably clean and orderly condition. <br /> <br />7.14. Use of Yard Areas: Use of the exclusive use yard area appurtenant to a Unit by the Owner <br />or other Occupant of the Unit shall be limited to passive uses that do not disturb other Owners or <br />Occupants within the Project. There shall be no use of storage of any items within the yard areas, other <br />than the use of furniture that is designed for outdoor use that is in good condition and repair. Pets or <br />other animals shall not be left unattended in yard areas; keeping of dogs in yard areas shall be controlled <br />to avoid unnecessary barking and to control animal waste in yard areas. <br /> <br />7.15. Electric Vehicle Charging Stations: Notwithstanding anything contained in this <br />Declaration to the contrary, any provision in the Governing Documents that either effectively prohibits or <br />unreasonably restricts the installation or use of an electric vehicle charging station in an Owner's Unit, or <br />is in conflict with the provisions of Civil Code Section 4745, is void and unenforceable. <br /> <br /> <br />ARTICLE VIII. <br />INSURANCE; DAMAGE OR DESTRUCTION <br /> <br />8.1. Insurance: <br /> <br />A. Association Insurance: The Association shall obtain and maintain the following <br />insurance: <br /> <br />(1) An occurrence version comprehensive general liability policy insuring the <br />Association, its agents, and the Owners and their respective family members, <br />against liability incident to <br />the ownership or use of the Common Area or any other Association owned <br />or maintained real or personal Project; the amount of general liability insurance which the Association shall <br />carry at all times shall be not less than the minimum amounts required by Civil Code Section 5805; <br /> <br />(2) A policy or policies of fire and casualty insurance with extended coverage, <br />special form, without deduction for depreciation, for the full replacement value of insurable improvements in <br />the Common Area and the personal property of the Association. The Association may, but is not required, to <br />purchase earthquake insurance and other types of casualty insurance, in the Board’s discretion. <br /> <br />(3) workers' compensation insurance to the extent required by law (or such <br />greater amount as the Association deems necessary); the Association shall obtain a Certificate of <br />Insurance naming it as an additional insured in regard to workers' compensation claims from any <br />109
