<br />Owner of invoices therefor.

<br />10.6 Unauthorized Improvements: If any Improvement is made without first obtaining approval of
<br />the Architectural Committee, the Architectural Committee shall give written notice to the Owner of violation of
<br />this Declaration within one hundred eighty (180) days after actual completion. If the Architectural Committee
<br />fails to give such notice, the Improvement shall be deemed to be in compliance with this Declaration. Within
<br />thirty (30) days of said notice, the Owner shall either remove said Improvement at his own expense and
<br />restore the Unit to its condition prior to commencement of said Improvement, or submit plans and all other
<br />items required by the Architectural Committee, together with an additional late application fee, in an amount
<br />determined by the Architectural Committee, which fee shall be payable to the Assoc iation. If the Owner has
<br />failed to take such action within said thirty (30) day period, the Association, at its sole option, may enter the
<br />Unit after three (3) days' written notice to such Owner and perform or cause to be performed, such work or
<br />other acts as may be required to remove the non-complying Improvement or remedy the non-compliance,
<br />and the Owner of said Unit shall forthwith pay all costs and expenses incurred in connection therewith upon
<br />presentation to Owner of invoices therefor. If the Owner chooses to submit plans, the Architectural Committee
<br />shall determine within sixty (60) days from the date of filing the late application if the plans are acceptable
<br />and if the Improvement is in compliance with said plans. If the Architectural Committee notifies the Owner of
<br />disapproval of the plans or of non-compliance of the Improvement within said sixty (60) day period, the
<br />Improvement shall be removed by Owner unless an extension of time is granted in writing by the Architectural
<br />Committee in its sole discretion to permit modification of said plans and/or to permit the Owner to remedy the
<br />non-compliance. If the Architectural Committee fails to notify the Owner of disapproval or non-compliance
<br />within said sixty (60) days period, the plans shall be deemed approved and the Improvement shall be deemed
<br />in compliance with said plans. The Architectural Committee shall also have the right to obtain injunctive relief
<br />to prevent a breach, or threatened breach, of the provisions hereof in addition to any other rights and remedies
<br />the Architectural Committee shall have in law or in equity.

<br />10.7 Non-Liability: Neither Declarant, the Architectural Committee, nor any member, agent, or
<br />employee of Declarant or the Architectural Committee, shall be liable to any Owner for any loss, damage, or
<br />prejudice suffered or claimed on account of (i) any defects in any building or other structure erected,
<br />constructed, installed, placed, altered, or maintained in accordance with or pursuant to any plans and
<br />specifications, exterior materials, color scheme, plot plan, grading plan, or other material approved by the
<br />Architectural Committee or any conditions or requirements that may have imposed with respect thereto, or
<br />(ii) approval or disapproval of any item submitted to the Architectur al Committee by an Owner. Approval by
<br />the Architectural Committee shall not be deemed a representation or warranty that the Owner's plans and/or
<br />specifications or the actual construction of an Improvement comply with applicable governmental ordinances
<br />or regulations, including but not limited to building codes.

<br />10.8 Access to Premises: Each member of the Architectural Committee, Declarant, and any agent
<br />or employee of the Association or Declarant, after the Association has given written notice, shall at all
<br />reasonable hours have access to any building, site, premises, residence, building, or structure constructed,
<br />placed or maintained upon any portion of the Project for the purpose of inspection of the same relative to
<br />compliance with this Declaration or for repairing or remedying any noncompliance as provided in this
<br />Declaration, and shall not be deemed guilty of trespass by reason of such entry.
<br />
<br />10.9 Architectural Guidelines: The Architectural Committee shall have the right, from time to time,
<br />to adopt architectural guidelines relating to any Improvement, alteration, or construction in any Unit or in or
<br />on the Common Areas in order to provide for the uniformity and the attractiveness and value of the Project
<br />as a whole; provided, however, that such gui delines shall not be in conflict with any of the provisions of this
<br />Declaration.

<br />ARTICLE X I .
<br />ENFORCEMENT OF BONDED OBLIGATIONS
<br />
<br /> If Common Area improvements which are included in the subdivision offering coveiring this Project
<br />have not been completed prior to the issuance of a final public report and the Association is an obligee under
