DocuSign Envelope ID: 0749BB4A-FC73-4892-982C-4BF1E9E16336 AMENDMENT NO.2 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND TRB + Associates FOR Plan Check Services This Amendment No._2 ("Amendment") is made by and between the City of San Leandro ("City") and TRB & Associate ("Consultant") (together sometimes referred to as the "Parties") as of July 10, 2020, and amends that certain Consulting Services Agreement ("Agreement") dated June 18, 2019, between the Parties. WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided or has included in its contracted scope of work to provide certain consulting services including plan check services and building inspection to the City; and WHEREAS, the Parties amended the Agreement on April 1, 2020 (Amendment No. 1) to increase compensation by $125,000 to provide plan check consulting services to assist the City's Building and Safety Division meet high permit application demand; and WHEREAS, the Parties desire to amend the Agreement (Amendment No. 2) to increase the City Council approved compensation for FY20-21 of $200,000 for TRB by 25%, or $50,000, to an amount not to exceed $250,000 for a temporary, full-time senior building inspector to work up to 40 hours per week to assist the City's Building and Safety Division meet current high demand for building inspection services and assist with an unexpected and recent inspection staffing shortage; and WHEREAS, the Parties acknowledge that upon applications for building permits, the City's Building and Safety division collects additional Plan Checking Fees in part for the purposes of covering the cost of purchasing third party plan check and inspection services; and WHEREAS, the Parties agree that said Plan Checking Fees constitute recovered costs of plan check services and related services such as building inspection; and NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 2 of the Agreement entitled "Compensation" is hereby amended to pay Consultant a sum not to exceed $875,000 during the term of this Agreement; and 2. All other terms shall remain in full force and effect. This Amendment may be executed in multiple counterparts, each of which shall be an original and all of which together shall constitute one agreement.
