Because the work involves excavation it is possible that unforeseen conditions will be <br />uncovered, and these conditions may require a change in the contract scope. In order to avoid <br />delay and allow a timely response to change orders, Staff requests authority to issue construction <br />change orders up to 25% of the revised contract value. Authorizing 25% construction change <br />orders on the proposed increased contract value would equal a maximum contract value of <br />$156,598; or 90% above the original contract value. <br />Staff also recommends that $45,000 in funding be appropriated to the Heron Bay Levee <br />Maintenance Project from the Heron Bay Maintenance Assessment District fund balance to cover <br />the additional cost of this work and provide funding for the desired construction contingency at the <br />start of work. <br />Current Agency Policies <br />·Maintain and enhance San Leandro’s infrastructure. <br />Previous Actions <br />·On October 7, 2019, by Resolution No. 2019-168, City Council approved a contract with <br />Pacific Underground Services for $82,420 for the Heron Bay Levee Maintenance, Project <br />No. 2006.0111. <br />Committee Review and Actions <br />·On September 4, 2019 staff updated the City Council Facilities and Transportation <br />Committee on the project scope, cost and schedule. <br />Applicable General Plan Policies <br />·Policy OSC-1.2 Park Maintenance. Provide for the regular, systematic maintenance of <br />San Leandro’s parks and recreational facilities to prevent deterioration, ensure public <br />safety, and permit continued public use and enjoyment. <br />Permits and/or Variances Granted <br />Permits were obtained from the following agencies for this project: <br />·Army Corps of Engineers (including consultations with the National Fish and Wildlife <br />Service) <br />·Bay Conservation and Development Commission (BCDC) <br />·San Francisco Bay Regional Water Quality Control Board (RWQCB) <br /> <br />Environmental Review <br />This project was deemed Categorically Exempt per California Environmental Quality Act (CEQA) <br />section 15310 Class 1 (d) for existing structures.
