RESOLUTION THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2020-115 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO INCREASE <br />THE CONSTRUCTION CONTRACT CHANGE ORDER CAP AUTHORIZATION <br />FROM 25% TO 90% (FROM $20,605 TO $74,178; AN INCREASE OF $53,573) TO THE <br />ORIGINAL CONSTRUCTION CONTRACT AMOUNT OF $82,420 WITH PACIFIC <br />UNDERGROUND SERVICES; TO APPROVE AN INDIVIDUAL CHANGE ORDER OF <br />$43,262 OR 53% OF THE ORIGINAL CONSTRUCTION CONTRACT AMOUNT OF <br />$82,420 FOR THE HERON BAY LEVEE MAINTENANCE PROJECT, PROJECT NO. <br />2006.0111; AND TO AUTHORIZE APPROPRIATION OF AN ADDITIONAL $45,000 <br />FROM THE HERON BAY MAINTENANCE ASSESSMENT DISTRICT FUND <br />BALANCE FOR THE PROJECT 147-42-150-5240 IN FISCAL YEAR 2020-2021. <br />(PROVIDES FOR ADDITIONAL WORK FOR COMPLIANCE WITH MITIGATION <br />REQUIREMENTS OF REGULATORY AGENCY FOR THE HERON BAY <br />LEVEE PROJECT) <br />WHEREAS, the City of San Leandro did on October 7, 2019 award a construction <br />contract to Pacific Underground Services by Resolution No. 2019-168 for the Heron Bay Levee <br />Maintenance Project, Project No. 2006.0111; and <br />WHEREAS, change orders to clarify the work or respond to unusual existing conditions <br />are a normal aspect of public contracting and construction; and <br />WHEREAS, in order to expedite the delivery of public projects on schedule and on <br />budget, provide that subcontractors and workers are paid in a timely fashion, avoid as much as <br />possible costly delay claims, and insure that the City completes projects that are to the City's <br />highest standards, the City Council finds that providing authorization to the City Manager to <br />negotiate and approve change orders is in the best interest of public health, safety and welfare. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager or his designee is authorized to negotiate and approve cumulative <br />change orders for this project up to a maximum of $74,178, or 90% of the original contract <br />amount; and <br />That the City Manager or his designee is authorized to negotiate and approve an <br />individual change order of 53% of the original construction contract in the amount of $43,262 for <br />permit -mandated debris removal work; and, <br />That $45,000 be appropriated from the Heron Bay Maintenance Assessment District <br />(Assessment District 96-3) fund balance to account 147-42-150-5240 for the subject project. <br />Introduced by Councilmember Cox and passed and adopted this 8th day of September 2020, <br />by the following vote: <br />
