IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2019-137 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE A NON- PROFESSIONAL SERVICES AGREEMENT WITH MILDRED HOW ARD FOR THE DEVELOPMENT, FABRICATION, AND INSTALLATION OF A '\VORK OF ART TO BE INSTALLED IN FRONT OF THE SAN LEANDRO MAIN LIBRARY FOR AN AMOUNT NOT-TO-EXCEED $135,000 '\VHEREAS, an agreement between the City of San Leandro and Mildred Howard, a copy of which is attached, is preseo.ted to this City Council; and '\VHEREAS, the City Council is familiar with the contents thereof; and '\VHEREAS, the City Council desires to enable the City of San Leandro Arts Commission to execute any procedural steps associated with developing the design of the work of art that is authorized by said agreement in pminership with the artist, with the final design presented to the City Council at a future meeting for final approval; and WHEREAS, the City Manager recommends approval of said agreement. NO'\V, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: • That the contract with Mildred Howard for a not-to-exceed amount of $135,000 to develop, fabricate and install a work of public art at the San Leandro Main Library is approved, and the City Manager or his designee is hereby authorized to negotiate any final terms or minor modifications, subject to approval as to form by the City Attorney, and execute said agreement for the services outlined therein. • Furthermore, the funding from the Fiscal Year 2018 -19 Adopted Budget, Account # 0 l 0-14- 0 I 0-8516, in the amount of $135,000, will be carried over to the Fiscal Year 2019-20 Adopted Budget in Account #010-14-010-8516 to provide the funding needed to complete the project.
