IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />HESOLUTION NO. 2019-137 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND <br />AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND EXECUTE A NON- <br />PROFESSIONAL SERVICES AGREEMENT WITH MILl>RED HOWARD FOR THE <br />DEVELOPMENT, FABRICATION, AND INSTALLATION OF A WORK OF ART TO HE <br />INSTALLED IN FRONT OF THE SAN LEANDRO MAIN LIBRARY FOR AN AMOUNT <br />NOT-TO-EXCEED $135,000 <br />WHEREAS, an agreement between the City of San Leandro and Mildred Howard, a copy of <br />which is attached, is presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; and <br />WHEREAS, the City Council desires lo enable the City of San Leandro Arts Coinmission to <br />execute any procedural steps associated with developing the design of the work of art that is authorized <br />by said agreement in pnrtnership with 1he artist, with the final design presented to the City Council at a <br />future meeting for final approval; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />• That t.he contract with Mildred Howard for a not-to-exceed amount of $135,000 to develop, <br />fobricate and install a work of public art at the San Leandro Main Library is approved, and the <br />City Manager or his dcsigncc is hereby authorized to negotiate any final lerms or minor <br />modifications, subject to approval as to form by the City Attorney, and execute said agreement <br />frlr the services outlined therein. <br />• Furthermore, the funding from the Fiscal Year 2018-19 Adopted Budget, Account# 0 l 0-14- <br />0 l 0-8516, in the amount of $135,000, will be carried over to the Fiscal Year 2019-20 Adopted <br />Budget in Account #0l0-14-010-8516 to provide the funding needed to complete the projed. <br />Introduced by Mayor Cutter and passed and adopted this 15th day of July 2019, by the <br />following vote: <br />Members of the Council: <br />AYES: Councilmembers Aguilar.
