FIRST AMENDMENT TO THE LICENSE AGREEMENT <br />This First Amendment the Non-Exclusive License (the "License") between the <br />City of San Leandro, a California charter city ("City") and Prop SF ("Prop"), a Limited <br />Liability California Corporation, is effective as of January 8, 2019. <br />WITNESSETH: <br />WHEREAS, City and Prop entered into the License on February 4, 2019 (the <br />"Effective Date"), to provide Prop with access to the Wes McClure Public Boat Launch <br />and associated Parking Area for Prop to conduct a daily private charter boat service; <br />and <br />WHEREAS, Prop has yet to begin operations of the daily private charter boat <br />service; and <br />WHEREAS, the License provides that it will expire on the first anniversary of the <br />Effective Date; and, <br />WHEREAS, the City and Prop desire to extend the License for an additional <br />year; and, <br />WHEREAS, the City Manager is authorized to execute amendments to the <br />License. <br />NOW, THEREFORE, the City and Prop hereto do mutually agree as follows: <br />1. The first sentence of the first paragraph of Section 2 "Term of License" is <br />amended to the following (with text additions shown in underline removed text <br />shown in strikethrough): <br />This License shall commence on the Effective Date and will expire on the fH:st <br />second anniversary of the Effective Date (the "Expiration Date"). <br />2. All other provisions of the License remain unchanged except as modified by <br />this First Amendment. <br />IN WITNESS WHEREOF, the City and Prop have executed this Amendment <br />effective as of the date hereinabove written.
