<br /> <br /> <br />ARTICLE 3. ADMINISTRATIVE REGULATIONS <br />2.10.400 Development Plan Review <br />A. Applicability. Development sites of five or more acres shall obtain Development Plan approval pursuant to <br />Chapter 5.14 prior to or concurrent with obtaining any subdivision, site plan review, or other zoning permit <br />approval. <br />2.10.404 Site Plan Review <br />A. Applicability. Site plan approval pursuant to Chapter 5.12 Site Plan Approval is required prior to issuance of a <br />building permit for the following improvements: <br />1. Development of new structures. <br />2. Additions, or partial demolitions with reconstruction, resulting in a net enlargement of an existing <br />structure. <br />3. Major structural upgrades that extend the economic viability of existing structures and sites that <br />are nonconforming to the development standards of this Code, as determined by the Zoning <br />Enforcement Official. Such structural upgrades include, but are not limited to, the extensive <br />demolition and reconstruction of exterior walls or the relocation of a significant portion of the <br />building’s structural interior walls. <br />4. New or expanded outdoor storage areas or truck loading bays. <br />B. Site Plan Review for Projects with Development Plan Approval. The Zoning Enforcement Official shall be the <br />decision maker for Site Plan Review applications with prior Development Plan Approval pursuant to Chapter <br />5.14. The Zoning Enforcement Official shall approve, conditionally approve, or deny the Site Plan. <br />2.10.408 Administrative Exceptions. <br />A. Standards for Which an Administrative Exception May be Approved. The Zoning Enforcement Official may <br />approve an Administrative Exception as specifically identified in any section of this Chapter. <br />B. Application Requirements. Application for such approval shall be made to the Zoning Enforcement Official <br />on a form prescribed by Planning staff. <br />C. Procedures. <br />1. Review Authority. The Zoning Enforcement Official shall act as the Review Authority for <br />Administrative Exception applications based on consideration of the requirements of this Chapter <br />except in the case of concurrent processing pursuant to Subsection C.5, below. <br />2. Findings Necessary for Approval. The Zoning Enforcement Official may approve an Administrative <br />Exception upon a determination that the proposal would not be detrimental to public health, safety <br />or welfare and would not cause undue damage, hardship, nuisance or other detriment to persons or <br />property in the vicinity. The Zoning Enforcement Official shall deny, approve or conditionally <br />approve the application. <br />3. Notice of Decision. The Zoning Enforcement Official shall notify by mail the applicant and all <br />abutting property owners. Said notice shall contain a statement that the action taken will become <br />final within 15 days from the date thereof unless appealed in writing to the Board of Zoning <br />Adjustments. The action of the Zoning Enforcement Official shall be final unless an appeal is filed.
