C. The virus is spreading rapidly across the region with many clusters <br />arising within retail stores. Grocery stores remain a critical piece of <br />infrastructure in the fight against the COVID-19 virus and in protecting the <br />City’s food supply chain. <br /> <br />D. Grocery stores are the primary points of distribution for food and other <br />daily necessities for the residents of the City of San Leandro and are <br />therefore essential to the vitality of our community. <br /> <br />E. Turnover, inability to pay for housing and increased childcare costs as <br />a result of school closures and other necessities could become an <br />immediate problem for certain grocery workers if they are not given <br />immediate financial relief. <br /> <br />F. To protect the food supply chain and the public health and safety, the City <br />of San Leandro must take steps to guard against turnover and ensure <br />that grocery stores in San Leandro have well-trained, consistent, and <br />stable staffing. <br /> <br />G. The City Council of the City of San Leandro finds that there is a current <br />and immediate threat to the public health, safety and/or welfare and a <br />need for immediate preservation of the public peace, health, welfare and <br />safety that warrants this ordinance, which finding is based upon the facts <br />stated in the recitals above, and in the staff report dated February 16, <br />2021, as well as any oral and written testimony at the February 16, 2021 <br />City Council meeting. <br /> <br />SEC. 5 RESERVED <br /> <br />SEC. 6 DEFINITIONS <br /> <br />The following shall apply to this Ordinance: <br /> <br />“Base Wage” shall mean the hourly wage paid to Covered Employees as of the <br />effective date of this Ordinance less Hazard Pay owed under this Ordinance or <br />other premium hourly rate already paid to compensate Covered Employees for working <br />during the pandemic (referred to herein as “employer-initiated hazard pay”). <br /> <br />“City” shall mean the City of San Leandro. <br /> <br />“Covered Employer” shall mean: <br /> <br />(a) Retail food establishments defined herein, that employ 300 or more <br />employees nationwide regardless of where those employees are <br />employed, including but not limited to chains, integrated enterprises, or <br />franchises associated with a franchisor or network of franchises. <br /> <br />(b) To determine the number of employees, the calculation shall be <br />based upon:
