Amendment No. 3 to <br />Consulting Services Agreement between City of San Leandro and 10/29/2020 <br />Kimley Horn for Davis St and Carpentier St HAWK Signal Project Page 1 of 2 <br />AMENDMENT NO. 3 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />KIMLEY HORN <br />FOR <br />DAVIS ST AND CARPENTIER ST PEDESTRIAN SIGNAL PROJECT (2016.0550) <br />This Amendment No. 3 (“Amendment 3”) is made by and between the City of San Leandro (“City”) <br />and Kimley Horn (“Consultant”) (together sometimes referred to as the “Parties”) as of <br />__________________ , and amends that certain Consulting Services Agreement (“Agreement”) dated <br />September 8, 2017 and Amendment 1 (“Amendment 1”) dated July 11, 2019, and Amendment 2 <br />(“Amendment 2”) dated July 11, 2020 between the Parties. <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to HAWK Pedestrian Signal Design; and <br />WHEREAS, the Parties desire to amend the Agreement to design the HAWK Pedestrian Signal <br />proposed for the intersection of Davis Street and Carpentier Street. <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br />1.Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed FORTY FIVE THOUSAND TWO HUNDRED THREE DOLLARS ($45,203) <br />2.Exhibit A of the Agreement entitled ‘Scope of Work’ is hereby amended to add the following <br />subtask: <br />Task 7 <br />Pothole one location at the southwest corner of Davis St and Carpentier St. to identify any <br />utilities in conflict with the proposed location of the new pole. Backfill excavation with a <br />concrete plug flush with the sidewalk. <br />3. Exhibit B of the Agreement entitled “Compensation Schedule and Reimbursable Expenses” is <br />hereby amended as follows: <br />Tasks 1-6 on Original Contract: <br />Subtotal $33,795 <br />Amendment No.2; Specifications update from 2015 Caltrans to 2018 Caltrans Standard: <br />Subtotal $6,500 <br />Task 7: Pothole for Utility Conflict: <br />Subtotal $4,908 (Revised) <br />New PO Total: $45,203 (Revised) <br />DocuSign Envelope ID: 8E0AB527-7DFC-41D3-9443-E1DAEE836DF8 <br />January 7, 2021
